Termination of DVC Membership Due to Misconduct?

I am a new member and have not yet had a chance to receive and review my membership materials, so my apologies if the answer is easily found. Fortunately, the title does not refer to me being terminated, but to a distant relative who unfortunately has had some emotional issues.

What happened, as best as we can figure out from what we were told, was that this person caught a bus from a villa to one of the parks shortly before closing time. At some point after pulling away from the bus stop, the driver informed this person that they would not be able to get off the bus at the park due to it being closing time. They asked to be let off the bus so they could walk back to the villa, but the driver said that this could not be done for safety reasons.

Things start to get a bit fuzzy in the story, but apparently the person created a major problem at this point by demanding to be let off. Words were exchanged, and security was called in to resolve the situation. The person had their arm trapped in the door of the bus, which resulted in a request for them to go the hospital that was apparently not followed. They left the park the day after the event, but a few days before the scheduled flight home. We are assuming the person was asked to leave the park although we were never told so. Fortunately, the rest of the family members that were there were able to stay until the scheduled end of the trip. I will say that I believe this person's behavior was inexcusable, and I really do feel bad for the driver and anyone else in the bus.

The reason I ask the question is that another family member was considering purchasing the DVC membership before the trip to help with financial issues. If the account is in danger of being terminated, however, this would not be a good idea and I would like to advise my relative against doing this. Can a DVC membership be terminated for reasons like this?
 
Honestly, I have no clue about terminations.

BUT ... one family member cannot just buy another family member's DVC interest anyway. Disney gets Right of First Refusal on any resales, so they have the option of purchasing the DVC interest back from the seller in all cases. So not really answering your question, but just letting you know that it might not be as simple as you think to sell the interest among family members anyway.

The CM that appeared to be in charge informed the man that MS would be contacting him regarding the termination of his contract. :scared1::scared1:

So rule #1 don'r be mean to people who serve your food. Rule #2 don't mess with CMs that know your identity.:thumbsup2

WOW - where was that castmember when a DVC owner berated the people at boardwalk bakery because they would not deliver their order to their villa. Is this this service $40,000 buys. It was quite ugly.

It only ended when my husband - in best New York style asked if everyone pitched in toward your $40,000 would you go away?

so who do we complaint to about rude and mean very rude CM's at the front desk (this only happened at oKW)
 
I wonder what happens to a person's contract or contracts after they get terminated.

Do they get a refund? A full refund? Partial refund? No refund?

My guess would be no refund, but I am sure someone with more knowledge on this will reply. He was lucky that charges were not pressed....If you do that on an airplane they cart you off to jail.
 
I know this is not usually posted on these boards. But this question sounds like a question for the DVC guide. The guides are not allowed (by Disney) to post to these boards. But I would think they would know:

1) if the above mention member can have his contract revoked and how;
2) how it would affect the member's family especially if the spouse is on the contract
and
3) whether the new contract your other family member is considering would not be connected to this out of control family member's account. (I don't see how it could, if you are buying a first time contract.)

Disney does not have a right to "terminate the contract" for bad behavior. What you heard was a loose phrase for what they can do. It does have the right to suspend a particular member's ability to make reservations such as for not paying dues. DVC is also subject to Disney's in general rule that Disney can remove unruly guests from the property and bar them from returning which would mean suspension of reservation rights. Such would not prevent sale of the contract to another who would then have full benefits. Also, single non-violent events are not likely to lead to a suspension as long as proper apologies are made (Disney knows that even usually courteous people can sometimes have a melt-down). Nevertheless the bus incident was very serious because it sounds like a safety hazard was created

Contact Member Services, for truly no one here can tell you what they will do. I am sure DVC legal would have to be involved.

Also something not right about this, if the parks are closing and guests are not being allowed into the park, you are not allowed to board the bus to go there in the first place and the driver should have told the guest this when they boarded. So either the details are not clear or the bus driver messed up.
 
I had to sign a behavior contract....Now, just in MY case, I am assuming, I pull some bonehead stunt, or someone using my points does, they can terminate me.....WHICH is why, I would NEVER rent out my points...I am too nervous someone would ruin my incredible gift......

I too am not aware of any rights within the POS to terminate the rights directly, indirectly it's only with foreclosure. They could legally prevent a given person or persons from being on property given the proper legal moves and essentially force the sale of a given membership.
 
Thanks everyone for the information. The information provided will be very helpful in helping us decide how to proceed. The amount of knowledge on these boards is very impressive, and I appreciate your replies and look forward to participating in the forums going forward.
 
I'm too lazy to read through my contract, but I think it is highly suspect that Disney could do that. DVC has granted the purchaser a deeded real estate interest in one of the DVC resorts. It's not as simple as DVC just washing its hands of someone who is out of control. At the very least, DVC would have to buy the owner out, and I'm sure given the situation the OP has described, that the owner is ripe for a lawsuit anyway (especially given the alleged "injury"). :sad2: :sick:
