Special Needs Trusts

Do you work with a service coordinator/case manager? They should be able to point you in the right direction. I only have experience with this in NY but there are non-profits cropping up that will help you sort through future care planning for no consult fee. There would be a fee for the lawyer but they would direct you to someone who specializes in this type of situation. I agree with others that have advised against trusting it to another family member and doling money out, as needed. In NY you can name a family member (or really anyone that you would trust in this position) of a trust as the rep payee and they can decide what the money goes towards and how it is spent, I would imagine that it is similar in other states, as well. They do not need to be a legal guardian and it is much easier to change a rep payee than it is to re-establish legal guardianship, if need be.
 
I can't help with the cost question but I can tell you to DO IT! A living trust is the only SURE way to make sure she is taken care of. The trust will make sure all her needs are met and no one can take that away from her. Make sure it's done RIGHT- with a lawyer. They run $3000 in my area.
