Shouldn't these charges be dropped?

Have you tried to find a pay phone lately? They are very hard to find around my parts, I think they think everyone has a cell so pay phones are very rare.
 
So, if I see a child being beaten I shouldn't run over and stop it??? I should patiently wait for the police to arrive, all the while feeling I could have prevented more damage???

He didn't SEE anything. He heard noises he presumed were a rape. If you broke in my house because my child was screaming and crying and you thought he was being beat, but in reality he was having a temper tantrum, would you be in the right? I think not, and in Florida I'd have the right to shoot you.

And if it was MY HOUSE you would be shot (especially with the guy having a weapon).

No need to run around breaking doors down. Contact the proper authorities. Even if there was a rape going on, the results could have been even more tragic for everyone involved.
 
Nobody ever mentioned "Rape porn". Police saw/listened to the video. He was just playing it too loud.

Do women scream for help during typical acts of sex? This "screaming for help" during a porn would constitute rape porn....porn where a woman appears to to forcibly made to engage in sexual acts.
 

God Bless him. In today's society so many people are unwilling to come to a stranger's rescue.

There was no "intent" as he thought he was coming to the defense of a woman who was being raped and/or murdered. The charges should be dropped.

I agree. He should have gone to another neighbors apartment and called the police. I do think he needs to plead out his case, get counseling and do some community time.

I don't think we can just go knocking down the doors of our neighbors because we hear things and we interpret that to be a crime. People watch many types of show and videos today that are loud and violent. If you think a crime is being commited, contact the authorities.

Years ago, my DH and I lived in CA and the apartment below us had two alcoholics living together, and unfortunately when they got drunk and loud, the male also became very physically abusive. My DH and I never went down stairs and pounded on the door, but we did call 911 all the time and the police would respond. The sad thing was, the woman would never press charges, and they would be together again. Then the fighting would start all over, and you would hear her being thrown against the wall.

Then one day, while my husband was traveling on business, it happened again. I called the police, they came, nothing happened because she insisted there were no problems. 10 minutes after police leave, he's banging on my door, trying to get into my apartment, to talk to me to have me stop calling the police. Luckily, I dialed 911 and they got there in time to see him threatening me through the door, and he was arrested. Guess what? girlfriend, all bruised from head to toe goes and bails him out. A few days later, they dissapear forever. I was happy they left, but I know she probably ended up dead, if not from the alcohol, then from the continual beatings.
 
I think the guy was brave- he got involved and tried to stop what he thought was a crime being committed. I agree with the poster who thinks he's a Good Samaritan.

I agree! He heard what he thought was a woman being raped and he acted. His adrenaline was probably pumping and he just reacted. I'm glad that noone was hurt and I really hope that charges are dropped. Things like this are why people are so afraid to get involved these days, imo.
 
Lot's of assumptions.

Assumption that it was an apartment complex, it could easily have been a duplex in the middle of nowhere.

Assumption that a payphone is on every corner. When I lived in a large and sprawling complex in NJ, the closest payphone was over half a mile away, and at night 99% of the residents wouldn't have answered thier door had I knocked asking to use the phone.

I believe that the man acted in good faith to stop what he reasonably believed was a violent act in progress.

IMHO he should be made to pay for the repairs and worst case be cited for disorderly conduct.

Even without a phone he should've went to neighbor or a pay-phone and called for help first.

No matter his intentions, he threatened a man with a deadly weapon. He should be charged.

Guy upstairs should turn down the daggum surround sound!

I think the guy was brave and heroic and trying to stop what he thought was a violent crime in progress. He should pay for the door and the charges should be dropped.

If I were being raped, I would hope somebody like this was in the next apartment and not some of you "call-the-police/knock-first/find-a-payphone" people.
 
As the facts come out .... This man is a danger to society!

He didn't break the door down as it was happening, it was hours later. Movie was watched late at night, he broke the door down in the morning.

He has a prior arrest for impersonating an officer.

The movie had no screams in it just run of the mill porn. You can't just charge into an apartment hours later with a sword, He could have found some one with a phone he wasn't in the middle of a National forest. Before defending him find out the facts.

Really? You want someone entering a volitile situation like that with no training that will most likely end with him and you being killed? I'll take my chances with the one who contacts the proper authorities who are trained in tactics and weapons.

I feel sorry for him. When your faced with that kind of situation, you don't think about all the other options you might have, such as having another neighbor call the police, etc...you just want to help. But, as the owner of the apt...I would have freaked out and thought he was a crazy person. I don't know if the charges will stick once in court.

Edited: Just read the update that he smashed the door down several hours later....if this is the case...he is crazy and needs help!
 
When we used to live in a townhouse, sometimes I would scream when I sneezed (don't ask:rolleyes: ) and my husband would say that one of these days the neighbors were going to call the police thinking that I was being murdered.:rotfl: I think the guy definitely overstepped.

Putting aside for a moment, the new info about it being hours later...YES, I would absolutely want somebody to come charging in if I was being raped. I HONESTLY hope I never have to find out if my feelings now would hold up in the situation. If I'm being raped and the guy is going to kill me anyway, waiting those crucial few moments for the police to arrive is the difference between life and death. Somebody charging in will likely startle the attacker enough to allow me to escape to defend myself. Sure the guy could've had a gun, but in that case he was gonna shoot me anyway. Bets case scenario(in a real rape situation) is that the perp is subdued by the samaritan or is scared off...worst case is the perp shoots/stabs BOTH of us. If perp does nothing or wastes time SEARCHING for help/phone, I either get raped or raped AND killed. So SURE I would definitely want someone to intervene, cause all those other options are bleak.

All that said...if the guy did wait hours to bust down the door, then it is a WHOLE nuther story and it would appear that the guy has some issues.
 
Dirty guy watched his movie from 1 am to 2:30. Movie was in Spanish. Crazy dude busted down the door at 11.

Police listened to tape and stated there wasn't anything in it that would sound like a woman was being injured.

This is what I heard this morning on the news.

In a heart beat. Without the heroics of citizens willing to put themselves at risk, how many more people would be victimized or killed? Maybe you live somewhere with a reputation for quick police response, but I live in a rural community with a small police force. It would take at least 15 minutes on an average day for someone to get here. And if we were at our place in the country it would be 45 minutes.

This is all based on a sane person trying to help, and not the nutcase in this scenario.
 
I can see coming to someone's rescue in certain settings, other settings not so much. But then I am looking at this through the eyes of a law enforcement wife. Too many things to go wrong breaking into a home and not knowing what is REALLY going on in there.
