Seller backed out after almost 3 months of waiting. :(

So, the title pretty much says it all. I should have known something was up when it took them 3 weeks to sign the contract. I just figured they were slow...maybe not very tech savvy, older people, etc. Then my broker (dvcresalemarket) called me a few weeks after the contract was finally signed to say that the seller has run into some financial problems, something about flooding in their house, have to have the floors repaired, etc. Asked if I could give them "more time" to get money to the closing table. Apparently, they were underwater with the contract due to loans and needed to bridge the gap at closing. They wanted until May 24 to give them extra time, or they were going to pull the contract. Fine. (For a timeline, they accepted my offer on March 4 - ROFR passed around the 24th, they signed the contract around the April 26th, I think.) So it was about another 3 weeks after that, I get this bombshell. So, we agree to May 26 because I didn't want to lose the contract. May 26 comes along, the broker calls me - they can't come up with the money and are pulling the contract. I am so upset. I don't know if I am more upset with the sellers or my broker. I have had thousands of dollars tied up for months now -- since March 4!!! and I have nothing to show for it. My money is still in escrow.

Here is the kicker: It was a beautiful CCV contract 100 points, for $140 per point. December use year. Now they are listed for up to $180per point. Had I pulled this contract sooner, I could have bid again before the prices skyrocketed. But they kept insisting that they were confident that the seller really wanted to offload this contract and if I could just be a little more patient. Now look where I am. I think I am going to ask for my funds to be returned, and I am going to buy direct. I am so sick of this process. I am back daily scouring all the various sites, getting put on notifications, taking up tons more time that I really don't have. Someone tell me why it is worth it at this point to try again. By the way, CCV direct is $225. The difference between resale and direct is getting smaller, and less worth this hassle. I already have 150 direct, so I would just be adding on. I haven't decided yet, but I have lost faith in this process. I feel they did me a huge disservice by encouraging me to wait. Thanks for listening.

I don't begrudge the seller from wanting to sell the contract at the best price possible, but it certainly feels like you were strung along for a few months. Not cool AT ALL. I hope you get your money back- stat. After this debacle, I'd totally be tempted to go direct too. I'm very sorry.
 

I am so sorry for you because it is a difficult pill to swallow.

I hold my breathe anytime I have bought and sold resale..currently doing both.. until we actually close because until that date either party could bail if an unexpected emergency happens.

I am so sorry! I wouldn’t jump to direct over that )since you have benefits and it looks like folks are still having contracts pass in the 140s?) but I’d sure go to a different agency.

I feel your pain on this, but your story also makes me really glad we walked on our contract when we didn't have closing documents by the closing date. We were assured by the broker that it was definitely going to still close, but we decided to pull out and buy direct. I'm so sorry this happened to you- I hope you weren't counting on the points to make a reservation soon!
 
was the contract stripped? Perhaps buying direct will get you a few more points on a December UY anyway and you can bank/rent to make up some of the difference, plus that instant gratification instead of the long wait :-)

So I wouldn't automatically assume that is the case.

same thing happened to me the seller made excuse after excuse but my issue was that i had lack of communication with DVC resale i knew something was up but if i want any news i had to keep calling i would of thought they would of stayed on top of it for me and email me the progress. Sellers excuse was the had marriage issues and could not get on the same page. But fortunately for me it finally came through
 
If the sellers were under water I wonder if they backed out because they saw how much prices jumped, close to purchase price. They could probably now sell their contract for close to what they paid. I am so sorry this happened to you. I had a seller back out once too and it stinks. I would probably go direct at this point, it's just easier. Also not sure if you are financing or paying cash but, direct is easy to finance.
 
Oh I’m so sorry!! Hopefully there’s an upside to this… it’s always stressful (it’s almost like having it taken by ROFR, but worse).

No it wasn’t totally stripped. But not loaded either.

Thank you. We just need to make reservations by December 17 for our next trip. And we need the extra points to make it work.
 
I'm so sorry this happened to you. If you do buy direct, I'd wait for add-on incentives. I don't think there are any for CC right now, but I would ask. They just expired a few weeks ago.
 
I’m so sorry that happened. It’s not a DVC story but when we bought our house we made an offer and wrote that it expired in 5 business days. On the 5th business day, which happened to be a Friday, we were told the sellers had a “family emergency” where they had to suddenly travel and they didn’t have a way to scan the contract back. But the realtor said they were definitely going to sign if we could just wait till Monday… then they had an open house that weekend with a newly reduced price slightly higher than our offer 🙄 so the point of my story is, I no longer trust anyone if there is a delay. It’s possible your sellers couldn’t get the money to close, but it’s equally possible they pulled out to list it for more money. So disheartening, but it’s not uncommon. According to most resale contracts, if the seller backs out, they still owe the agent their commission. So if they were just playing games to get a higher price, they would still owe the agent.
 
I'm so sorry this happened to you! I'd be very upset as well. If it makes you feel any better, while you may be seeing asking prices of up to $180 (especially with DVC Resale Market), we see plenty of CCV contracts on the ROFR thread for much less - many still in the $140's. So maybe take a breath and a few days before deciding to go direct at $225. Though it would certainly be understandable if you just wanted to chuck the resale process and go that route. Still, I'd take a few days, search the various resale sites and think about it.
