Sad I got scammed on E-bay out of a Mickey Jacket

I just needed a place to write my disappointment. I bought my DH a hubby a Mickey Mouse Varisty Jacket on E-bay. January 17th (my birthday) for him. So we would look cute in the same jackets on our trip to Disney World in December. I got mine from another seller. Well now she is saying it got delivered. When she knows it did not as we have written back many times. Because fed ex says on the web site it was delivered to me. I contacted them and they said there computer system on the web is wrong and that it was sent back to her because she did not fill out the customs forms needed to send it to Canada. I thought she was an honest seller with good feedback but it looks like I am not the only person who has a problem with her latley. I was helpful and patient and even wrote her the best and easiest way to ship it to me. She has just strung me a line. Now I know I was scammed and it hurts. Especially since we do not really have the extra cash to spend as we are saving for our trip. Hopefully if our savings go well I can get him one before we leave. In Canada they are double the price. I filed a complaint with fedex and they will give me written proof it never got out of the States. But I don't think the item is covered under paypal protection because I am in Canada. Does anyone know what i should do. It has really put a damper on my Disney trip excitment. I have sold a few things on Ebay (for our Disney trip)and for me the worst part is waitng to get confirmation it was recieved for the money is not truly mine until then. At least that is was an honest person should do. if the item is lost or damage the money should be refunded.
So if anyone knows how I might get my money back pleaselet me know. Thank you

I don't have any advice as I don't ship to Canada (sorry, but I had one big headache a couple of years ago and now I just ship to USA) But I wanted to just say I am sorry this happened. :sad2:
 
If your Paypal payment was with a credit card you can go to them...
 

You can still file with PayPal for your money back. At this point, you really have nothing to lose by doing so. You are still within the 45-day limit to file a claim.

If you used a credit card to pay for the item thru PayPal, you can also dispute the charge with your credit card company. However, you cannot do both a PayPal dispute and a credit card chargeback at the same time.

I'm sorry that this happened to you. I hope that you can get your money back. Good luck and let us know what happens.
 
I hope you do not need this, but if you want to advise others of this, contact the internet fraud complaint comittee. It is run by the government and will track down the individual and decide if fraud was intended. If so, the person can go to jail for up to 25 years.

I just wanted to thank everyone responding It has been very helpful. I have given the seller 24-48 hours to give me my money back since i am waiting for written proof from Fedex and for them to contact the driver ect. That will prove I never got it. I also kept 90% of the correspondence so they will see she knew it never came and the game she is playing now. I want as much info to take to Paypal so this is an open and shut case. For me it is shut because I never got the jacket. thank you for your support. Makes be feel a little better that I might get the money back but still sad that i have know jacket. But it is not the end of the world.
 
If it got sent back to her, is it possible it hasn't arrived yet? Then if she sees on the website it was delivered, she may think you have gotten it. It does happen! I have had two people say they didn't receive the items I sent, only to find out a neighbor had gotten one from her porch and the other guy had it delivered to work and didn't see it (after I sent del conf). I ordered a DVD from a Canadian seller and it took 3 weeks to receive, so I won't do that again.
 
She prob thnks you are trying to get the jacket and the money. Look at it from her side. The web site says it was delivered, and at this time, she may not know otherwise. Looks like she is getting a bad rap, and as far as she knows, she didn't do anything wrong. Fed ex should not have taken it to ship without the proper custom form. Seems to me the problem is with fed ex. I'd take it up with them. Your credit card won't reverse the charges, if she can show it was delivered:(

I would follow a complaint through ebay as well as through your credit card company if it doesn't get resolved in a fair amount of time

Plus,
Paypal will request the seller to show proof of delivery and if the seller provides the link to show it was delivered you might be out of luck until you can get a letter from Fed-Ex saying it has been returned.

I had a problem with a Disney Pin ($40) I had bought on Ebay about a year ago...The seller claimed she sent it and provided a deliver comfirmation that listed a city 60 miles away from me!

PAYPAL reversed the charges and then about 3 weeks later the Seller claimed the pin was returned to her finally after 6 weeks after she shipped it!

I'd say you or the seller should be filing a claim with FED-EX since it sounds like they might have a problem returning the item.

It just might take a little time...but good luck.

She can't prove it was delivered - she can only prove that she shipped it. You could have a good chance of getting your money back by filing a dispute with your CC if all else fails. But like others have said- give it a little time- DMRick is right- it sounds like a FEDEX problem- give the seller a chance and a little time to make things right.
 
For what its worth, shipping to and from Canada has gotten pretty tricky lately. Customs rules have gotten very strict and items can be held-up at Customs for weeks.

The item may very well be on its way back to her, but it is probably sitting in some holding area waiting for clearance to be returned.

I understand that you may be disappointed, but you may want to give it more time to see what is happening.

(My mom lives in Ontario and mailing things to her is so difficult we usually end up driving 600 miles instead)

But in the very next sentence, the OP claims that her phone call to Fed Ex resulted in an admission of error in the information on the website.

My 1st advice to the OP is to get DOCUMENTED proof from Fed Ex that will back up the information you were given on the phone.

Yes, that is what she is waiting for. Fed ex said they would send her something. But in the meantime, the seller has the proof needed that is was delivered. Fed ex has it up on their site as delivered, and until they take it down.. well, the seller has her proof. Fed ex's phone call means diddly, since the credit card company isn't going to call them, if the on line search says it was delivered. I want to know how the package got scanned as delivered, if it wasn't. The problem is with fed ex, not the seller, at this point.
 
Without a signature as proof of delivery - regardless of what Fed-Ex's website says about it being delivered she could still dispute it with her CC as not being delivered. I had a simliar situation last year.
 
FYI -

My aunt in Florida sent a package to my mom, who lives in Canada. My aunt mailed the package AirMail on December 3rd. My mom recieved it yesterday.

I'm willing to guess your package is held up some where in customs and if you remain in contact with the seller, she will evenually be able to send it to you. Or at least give you a refund and she can re-list them item.

This is the reason many are hesitant to mail out of the country.
 
I was waiting for a package from the states through a courier company, they claimed to have tried to deliver it to me, and I know they never did because the address was a business address and there was someone there all day esp when they claim to have tried ie 11:30am. So I had a fight with the guy on the phone from the courier to tell them the idiot driver tried the wrong address for sure, or just lied. So keep up with fedex because obviously they screwed up. Get the local fedex manager, get him to get exact delivery records for the day it was supposedly delivered, and where it was left, since you didn't sign for it obviously.
 
Hello everyone thank you for your help. Just to let you know I got the jacket. The driver showed up and said "he did know how it got on his truck it seems to have been stuck in customs with no paper work so he has no idea how it got on his truck. After careful look at the paper work. It was resent on the same waybill number the day after it was shipped back to the seller. looks like it got stuck in customs again because it again had no paper work. Instead of sending it back they must have contact the seller and faxed them a document on the 10th. But by doing this it changed the waybill number it still had problems but got through anyhow. I did not even have to pay duty so I guess I benifited from the scew up. I wrote the seller and apologized to her for questioning her honesty. But I recommended that she be more aware of problems so she could contact the buyer. She must have filled out the form on the 10th or had someone do it on her behalf and if she let me know that then I would not have jumped to conclusions and would have realized it was probably customs also if I had had the new tracking number there would have been no issue. So I suggested she ship USA only. I know customs has gotten more difficult. Especially with couriers as part of my job is shipping items to the USA. But I have found for my personal use shipping air mail is earier to get through customs than ground courier because then you get into brokerage problems. So I totally understand why people do not want to ship outsidethe USA. Once again thank you for your help. I have learned a lot through this. Though it took 6 weeks to get here I am happy to have it. I still left postive feedback for the seller. Though mention should ship USA. I feel that was fair because I got my item and hopefully she also learned from this experience.
