My Resale was presented to Disney on Sept 15, I have confirmed this date with Disney....no decision has been made yet and only 2 days left....

Once it hits 30days is there anything I can do or do I keep waiting???

Most frustrating part is Gotribe just posted that his only too 12 days and it was pretty close to my deal exactly...well mine was for less points but other then that everything was the same....how does that happen...his is presented after mine and is approved and mine is still sitting there....ARRRRRR :listen: :listen:
 
There seems to be no rhyme nor reason to the whole ROFR process. It was roughly 2 weeks from the time our offer was sumitted til we got word from the broker that it had been passed.

It happened to me just last month. All others that were presented came back but mine. Pat at TimeShare Store told me it did not look good. Most likely Disney has approached the seller to ask them to buy back directly.

Pat contacted the seller and sure enough he received the offer from Disney. I had to raise my price and had them re-submit the offer to Disney and it got approved the 2nd time.

You should ask the broker to check with the seller to make sure Disney is not working with the seller to try to buy it back.
 

It's true, they usually notify the seller and not the broker. The broker should either call DVC or the seller to check. Odds are you're already too late.

2) Talked to the Closing Company today no decision
3) Then called Disney today...as of 10am no decision had been made
4) Both said they thought it should be soon....there are 2 days left.
5)Guess I'll email the seller to see if he has heard anything.

You should talk to the seller as well. Just because you were told no decision doesn't mean that's the case. Good luck.

According to the brokers I spoke to, the 30 day number is not an absolute limit. The last rofr was 12 working days which is almost three weeks. The average has been 20--24 days. I just got one back at 22 calendar days.

I specifically asked if they haven't said no at 30 days have I passed rofr. All answered the 30 days is not an absolute limit. The brokers mentioned the closing date as the absolute limit. I haven't seen any instances on this board that have gone 30 days.

I would make phone calls and keep an eye out for another deal.
 
We waited 35 days only to find Disney had taken the contract 2 weeks before. So make sure that is not the case.

As for the 30 days, it is more then a guideline, its a documented fact in our ownership docs. However, I think brokers are fuzzy on it because they are more interested in protecting their relationship with Disney, than they are with a buyer. If your broker confrims that Disney has not taken it with the seller then push to close. Contact the seller yourself if you have to.
 
Ok I've emailed the seller to check whether he has heard anything yet...as of last week he hadn't.....Hopefully I won't hear that he has....If he has; it wasn't ment to be and I save tons of money.....:teeth: :teeth:
 
We never heard if Disney exercised it's ROFR. WE got a letter from the TSS to see if our names were spelled correctly and we faxed it back. At that point we just "assumed" we were on our way to closing.

We got a call the other day to say we were closing on 10/16!! However, we never recieved the follow up email stating the amount of money we are to send (2 days from now!!). I have a call into the TSS and am waiting to get the specifics so I can get to the bank and get the check to them!!! I am anxiously waiting!!
 
OK as of Oct 14, 9am Day 29 the seller has heard nothing about the sale either....seems like there still is hope....:Pinkbounc :Pinkbounc :Pinkbounc

Many times closing companies work this way. If you get a closing statement you should be set. You should have gotten a statement that included all the accounting and how much you'd owe.

I'd say it doesn't look good but no news is good news I guess. Remember the 30 days starts from when they received it and not when you sent it.
 
Per Disney records it was recieved on Sept 15....I'm still holding our that it might work....if not I didn't lose any money and I'll keep looking (not in any hurry)....
 
Dean, I am still waiting for that information!!! It is a 270 pt. contract at OKW and it is a CASH contract!! I need to get to the bank!! LOL!!

I am going to call TSS again now!!

UPDATE: I just called and had them fax to me the necessary paperwork so that we can close on the scheduled day!! As I reveiw it, I notice they had our old email address from our first resale purchase a few years back!!!
 
OK...I'm on hold with TimeShare Closing Services....

While I ran out to pick up lunch they called ....get home ask did anybody call...DS...yeah somebody called...who? MMMMM...I don't know...Who did they ask for? You....are they calling back....MMMM I don't know....:confused: :confused: Caller ID says it is an extension of the TimeShare Closing....:earseek:

So, I call them back...

and ....THEY GOT THE WAIVER FROM DISNEY!!!!!


So, 29 days later....Disney says YES to my Bday Present.....
 
Congratulations!!!! Only five or six days until you can put your plans into action at MS.

Maybe DVC waived because they didn't want to tangle with the Evil Emperor! ;)

Unfortunately no action with MS anticipated....I'ved used all the MS magic with my December trip and no additional points available with this contract....
