rofr question

i'm trying to understand/research dvc, before buying...and i have many questions. i'm hoping this is the right place to post my questions. if not, please direct me elsewhere. thanx.

if you buy from resale, i understand disney has the option for rofr. is that when disney steps in to see if the price i am asking for is too low, or acceptable, right? and if they deemed too low, i just don't get the buy. now will i lose anything? and once disney execute this, am i not allowed to even buy dvc from resale. since i assume disney have ear marked my info as "denied". or maybe i have a "wait period" before i put in another bid?

If Disney excersises ROFR on a contract, it is on the contract, not on you as a buyer. They aren't going to track that it was a specific person who was trying to buy the contract. What happens in ROFR is Disney actually buys the contract back from the seller at the price you offer. That's why there seems to be a threshold for what Disney will accept for each resort. The offering is more than just the per point cost that Disney will look at too. It will also take into consideration if it's a stripped contract or one that has lots of banked points, and if the seller is asking the buyer to pick up past dues or closing costs.

Disney's ROFR is more about protecting the value of the DVC, not to "mark" a buyer or deny him/her the opportunity to purchase points. It doesn't put a smudge on you at all. Disney just buys that particular listing from that particular seller, and you then have to look for another suitable listing.

I don't know how all resellers work, but you shouldn't be out anything if Disney invokes ROFR. The reseller we are working with (see link to my blog below) refunds your deposit if Disney steps in.

Look for a reseller that has a lot of experience with DVC so they know what is likely to pass ROFR. They will warn you if your offer is too low. An inexperienced reseller won't know, and someone after a quick buck will knowingly let you put in an offer that is too low so that Disney will invoke ROFR and they won't have to do any work to sell it. They still get a commission if Disney buys.
