Retroactive insurance cancellation?

Anyone have any experience with this? I left my previous job, start a new one Monday. When I left my previous job I called to find out when my health insurance ended, spoke with several people who didnt know, was referred to one that knew. Left her several messages, never got a call back. Spoke with the insurance company Feb 2, was told still had active coverage and was given a confirmation number for the call.

Today I recieve notification that my previous employer cancelled my health insurance retroactive back to Jan 14, and that they intent to bill me for my prescriptions that I filled Jan 19. My employer did not notify them until Feb 3 to cancel.

Can they make me pay? I did everything on my part to make sure I was still covered, and they are still taking health insurance payments out of my pacycheck. I am getting the run around from the health insurance company and hr, and seem to be getting nowhere with either of them.

I would not have filled one of the prescriptions if it wasnt covered, it is several hundred dollars. Cant return it.
 
What was your last day at your former employer? I wouldn't expect to be covered after that date no matter when they notified the insurance company.
 
If your premium was paid you should have every reason to expect your coverage to continue until the end of the month in which you resigned.

Call the HR department at your former employer and have your wage statements in front of you with the deductions listed. Typically premiums are paid in advance or the first of the month for which you are to be covered.
 
Look at your Explination of benefits. It should tell you if your coverage is through the end of the month, or date of termination of employement.

It used to be that companies had 60-90 days to terminate their employees off of the health insurance.

Did you get a notification of COBRA coverage? You have 60 days from date of termination to enroll into cobra, and 45 days from the date of enrollment to pay the coverage in full. Electing cobra sometimes is cheaper then paying out of pocket for perscriptions and doctors visits until your new insurance kicks in.

We own a small business and BCBS rules say employee must be actively at work to be covered, so we generally cancel the day after or end of the week after they leave.

But we did have one case where the employee used the insurance for doctors visits right after they left employment. They used if before I sent in the cancellation notice. In that case, BCBS made us still pay for the insurance up to the last usuage of the insurance, not the cancellation date I requested.

I used to work for an ins. co., so I have some experience with this. All plans and employers are different, so it's impossible to say what's right or wrong as far as a termination date. It could be midnight of your last day of employment, or the end of the month. You would need to confirm with your HR and the insurance company to see which one applies to you. It also should be stated in the plan documents you received when you first enrolled. As far as premiums being taken out of your paycheck, it sometimes takes some time for the payroll dept to catch up with these things. (sometimes as much as 2 weeks) They may owe you some money if they deducted premiums after your coverage terminated. It's frustrating that you can't get a straight answer about this. When was your last day of work?

Last shift was Jan 14, official 2 weeks I gave was Jan 28. My boss refused my two weeks (she often does this) but it still went to HR with my official last day as Jan 28. I used the insurance Jan 19, it was retro cancelled back to Jan 14.

By the way, they still call me and beg me to come cover a shift. No thanks.
