I know that rules vary but generally speaking if we are just tearing up the old planks & replacing them, do we need a Building Permit??

Even if I needed one there is no way I would get one for this kind of project.

that varies from community to community, and i would call the permit office and check, some places use this sort of record to keep tabs on age and stuff of things like this

I wouldn't get one, and I really don't think you would need one, since you aren't changing the footprint of the deck.

You might want to contact your city's zoning and planning department to verify.

I looked it up on the Counties website & it's pretty vague "All Decks" well imo it's an existing structure, so I don't see why we would need one...

We just want to make sure either way.. we have a neighbor that we've (us & other neighbors) reported for illegal activities in the past & we don't want to give them any ammunition for retribution....

I'd call and check to be sure, but I'd think as long as you aren't changing the design of the deck (making it smaller or bigger) you wouldn't need one. But if you look like you are doing a lot of work and one of the inspectors drives by, he may think you're installing a new one and wonder why you don't have a permit. In my town most permits are $50, if I called and they told me I needed one, I'd go ahead and buy it so I wouldn't have to worry about it.

Since you're having neighbor problems, I would go ahead and check with the town (I sooo know how it feels to have neighbor problems!). If you do need a permit, it shouldn't cost very much. I think it will be worth getting rid of the worry about being reported by your neighbor.
