Response from DVC legal about renting/transfers!!! READ THIS

Thanks for all the interesting info.. I must lead a terribly boring life, whenever I want to go to WDW I simply use my own points and make a reservation. To date I have had no trouble booking either at my home resort or somewhere else, this includes F+W and the Flower show. Never tried Christmas to busy for me, but my sister goes to BWV every year between Thanks giving and Christmas. Never heard her complain about getting a room, last year they went from Christmas to New Years. Doubt if the average DVC owner even knows there is a problem..

I am just as interested as you are that there are one set of rules that are fair to all. Everything that I stated in my previous post was taken from a conversation that I had with Disney's Business, Standards & Regulatory Affairs and, yes, canceling a reservation at the time of check in WAS mentioned as a solution by that office as well as deeming anyone who offers points for rent on a web site, newspaper or "a sign in one's own office a commercial renter. Looking over the the posts on the Rent and Trade Board, I am not sure if you are an owner but apperantly it is OK with you to seek points from "commercial renters" (according to the latest POS interpretation by Disney) as long as the reservations are for you. I accept your apology.

I have nothing to apologize for. I did not pass judgement on you nor flame you as someone who rents...I just stated that since you are someone who clearly engages in great deal of rental activity, and because of that, your position on this issue makes more sense.

In terms of referring to you as a "commerical" renter...well as you have said, this is a loose term these days without a clear definition. My *personal* opinion is that anyone who owns way more points than they need for personal use and subsequently and regularly rents those points out for profit is a commercial renter. Again, that is *my* opinion, and we will all have to wait and see how DVC will define a "pattern of commercial activity."

Yes, I am an owner. I would think that the SSR logo attached to my posts would make that clear. Yes, I have also rented in the past (before becoming an owner). And I have NO PROBLEM with renting. I have said that in several threads. As an owner, I am very glad to know that you do not pre-book peak times to sell at auction. I am also glad that you do not morph points. Again, my comments were based on the fact that since you do rent a lot, I can understand why you said what you did.

Finally, while I am not questioning the veracity of the conversation you had with folks at Disney, I definitely cannot imagine an instance where waiting guests would be denied a reservation b/c it was a rented one. I do not believe that a Disney Gestapo exists, and I do not think that any renters would be treated the way you described in your post.
 
This should be interesting as this evolves since Disney guides have used the "idea" of renting as a selling tool for many years from my understanding. Because of our situation we had to buy more points than we would have liked to and would consider selling contracts and not spending our money at Disney if the changes made it so we do not have flexability and could not rent. May be it is time to check out other options especially since DVC does not provide as good a value outside of the DVC options.
