Resigning deeds?

Did anyone else get FedEx packages today to resign their deeds to change the registration? We were led by DVC to register our Aulani deed as "two individuals" even though we were married. Apparently, someone at DVC screwed up when they did this and really, our deed should be changed and re-filed. We only found this from a nice letter and forms delivered by FedEx today. The delivery person said that she had a bunch of these to deliver in our area today. I'm guessing that the person who did the forms when Aulani was released messed up and they found the problem. Did anyone else get this?

I'm not upset at all. They're going to reimburse us for the cost of the notary and enclosed prepaid return envelopes. Just curious how many people got this.
 
Nope and I hope we don't, at least not if they require notarization as that will require a trip to the USA to do it plus more notary charges that I'll gladly charge back.
 
When Aulani went on sale, there were some legal issues with the dues calculations and some other things. They were ordered to stop selling both in Hawaii and they stopped selling in other States also. It took several months to get started again but they didn't get their license to sell in very many States.

Remember the rules and laws for a developer are different from a broker or reseller.

My guess is that some legal issue popped up and this is the only way that they can fix it.

Refuse to sign and lets see what happens! :thumbsup2

Tags- it says that you can re-sign docs on your next trip to WDW, Anaheim, or Aulani, so no hurry and no free trip. Sorry. But for those of us who have to pay a notary, they're going to comp us $20 on our dues next year.

Nutz- they don't care if we don't sign. This is only about the way husband and wife are on the title. Currently, we're on as two individuals, not married couple. It's not a big deal, but should one die, it could be a minor headache (above and beyond the fact that one of us is dead). So DVC doesn't care if we don't sign. We can keep the contract as-is and it doesn't affect them. Moreso, this is one of those "nice catch" things on their part and they are really making it as easy on us as possible.

I wasn't saying a free trip.... I was saying the NOTARY would need to be covered, if they required notarized documents. Getting to the US takes me 20 minutes that part isn't a big deal.
 
We own at Aulani and did not get any Fed Ex package. But our titling is different than the one you mentioned. We always use Joint owners with rights of survivorship.
 
I got the fed ex title recording mail that talks about recording in joint tenant vs individual joint owners. It looks like a new contract.
I bought mine for aulani, but I bought mine during the intro period so I'm getting the subsided rate vs the standard dues rate. If I do this title change will I lose my subsided rate? Really strange why disney would automatically send a prepaid fedex envelope and offer to pay my notary public fees, just out of the blue without there being a benefit for them.

We received the Fed Ex letter yesterday as well. Same issue with the deeding of the Aulani contract. Need to read a little more of it and maybe call my guest services.
 
We got it too. Good thought about subsidized dues, we own at Aulani with subsidized dues.

Yes that's very interesting. What would happened if they rescinded the contract? Would the be due all monies since they purchased? I guess a real estate attorney could give a better answer.

I raised the question but I doubt even a timeshare experienced attorney would be able to say for certain. IF anyone were truly interested, talking to DVC's legal team would likely be the best place to start. My guess is that since it's been more than a year one couldn't legally cancel though if one refused to sign the deed change, it could get very interesting. It's entirely possible that DVD would refund the money (fees & purchase) in this situation minus a charge for any used nights. I'd bet it'd be open for negotiation. Ultimately it'd likely only be a reasonable direction for someone who truly wanted or needed out such as major buyers remorse or financial issues.
 
So far it seems as though the resigning is mostly with original buyers before they halted sales.

We weren't wise enough to buy at the lower rate with the lower dues... I've been kicking myself!
