Rental Contract

Hi Everyone,

We are renting out points for the first time and I want a basic contract to keep both sides comfortable with the transaction. Should I include anything about repsonsiblity for not trashing the room? If it is damaged beyond normal wear and tear does Disney hold me responsible? Any thoughts would be most appreciated.

Yes, the member may be held financially responsible for damages to the room.

Our DVC contract does state that rental contracts are required - but goes on to say that in the event there is no contract, the renter will be held to all conditions of the DVC membership regarding the use of the room.

"All renters must comply with the rules and regulations affecting occupancy, and the renting Club Member will be held responsible for the acts or omissions of his renters or any other person or persons permitted by the Club Member to use the accommodation." - Disney Vacation Club Membership Agreement, Exhibit "I" to Declaration of Condominium- Section IV. Rentals - Page 169, POS

The contract should provide any expectations for all involved- including (but not limited to) resort, room type, dates of reservation, payment agreements (including deposit and final payment dates), cancellation policy and any agreement about damage responsibility.

i have rented alot and i have never used a contract...........and never had an issue as yet............i just do not see the need..........you dont have a contract with a hotel and as long as you agree to be held to the same standards as a DVCer i will rent to anyone............
 
IMHO, whether you call it a contract or not, it's good to have something in writing -even if it isn't a contract per se. It helps to ensure understanding up front. For example, it's good for both parties to thoroughly understand what will happen if the renter changes his/her mind and wants to cancel the trip.

carol agree but that i swhat the emails are for and they are binding as well ................my lawyer says so anyhow..............
