Question about ROFR

To anyone that knows...

If Disney invokes ROFR and acquires a contract, can they break that contract up and re-sell it in parts?

I'm trying to understand the method to the madness :smooth: and have been wondering whether a contract might be more or less desireable to Disney based on it's size. For example, a 500 point contract might be harder for Disney to find a buyer for (so maybe less chance of ROFR being invoked?). But if Disney can break it up and sell it as 5 contracts @ 100 points each...then that theory might not hold water.

So I guess the question is, does Disney have to resell a contract they acquire through ROFR as the same single contract or can they break it into smaller contracts (size of their choosing) and re-sell accordingly?

Yes, Disney can divide the points however they wish. While individual owners cannot separate a contract, once the developer regains control of the points, they may resell them in any way they wish.
