question about memory maker

it is my understanding that with memory maker in order to get the ride photos you either need the magic band of the person the memory maker is assigned to or the memory maker card. Is this correct? If so if we split up could one person use the band and another use the card for ride photos?
 
Not correct. As long as you're in the Friends and Family list of the person the Memory Maker is assigned to and you choose to allow that person to share your photos, your magic band will work for getting ride photos.

I can confirm what they told me on the phone.
Could you quote the section that you feel contradicts this?

All Friends and Family that are linked will be on the MM. Only the MM owner can do the downloads.
 

I can confirm that your group does not all need to be together nor all with the MM owner to get ride photos. I had an extended family group of 12 and I was the MM purchaser. We were all linked as Family and Friends in MDE with the settings on "this person can view and edit your photos". My group often went on rides without me, only their own magic band, and all ride photos are captured.

I don't know if this one .catch" is referred to in the Disney FAQ, but only the MM owner can *see* all the ride photos through their MDE login. Strangely, if Uncle Bob is in another room and has his own MDE account but is linked to you for the Memory Maker: every time Bob stops at a photographer, his picture is captured in MDE. Also, when he rides an enabled ride, his picture is captured. However, when Bob logs in to MDE with his own username/password, he sees only the still photos and not ride photos. When you, the Memory Maker owner, login with your username/password, you see BOTH bob's ride photos and still photos.
 
When we went in November we had our MM split between 3 different families. I was the MM holder and everyone, including the kids, was on my friends and family list. We had no problems with the ride photos from all members of all families showing up.
 
The memory maker is linked to my account. When my husband took my daughter on Splash Mountain for the 4th or 5th time, those photos showed up on ours without him having my magic band.
