Question about apartment lease

What struck me odd is that they never asked you the breed of the dog, yet said its a "banned breed."

If they said "banned" I'm assuming, that they're assuming the dog is a Pit Bull as they're banned in almost all of Ohio (if not all).

ETA - when they were able to get hold of the VICK dogs, and bring them out West for rehab, and adoption and all that, they had to go ***around*** the state of Ohio when driving back with them, as Ohio will confiscate on the spot. Even if you don't live there.

OP - I'd be awfully careful right now. Depending on how important this dog is to you (and I'm assuming, quite so). You could get a sweet knock on the door, to take your dog. Do you have any proof this is NOT a Pit? I'd get that, and I'd get it quick.

See, and *this* is the problem with BSL. It's what someone's opinion of what a Pit Bull is.

There have been both Lab's and Boxers, removed from people's homes for being Pit Bulls. Not even 'pit bulls' who have bit, or been aggressive. Just for being (what they thought was a) pit bull.

Well, you really don't know what the other tennant told them about your dog. They might have told the rental office that you had a pittbull that was barely under control and foaming at the mouth and the rental office took their word for it. It could just be an issue of taking the dog to the rental office and introducing them to your pet, or providing documentation of it's breed.

That said, if the rental office/land lord sticks to their guns then it may be a bigger battle than it's worth. Most shelters will take a dog back if the new home doesn't work out, and while it's a shame, it could be best for all concerned. Good luck!

Thank you all for your help. I've decided to write a polite letter to the office and ask them to help me understand why they can enforce this restriction.

Why not just walk in and talk to them? Ask them what the problem is, etc?

Obviously the neighbor thought it was a PB, and if they are banned in your state, that's a problem. So go in and talk to them, let them know its actual lineage, ask what sort of proof they need, and go get it.

Seems really simple, and it bugs me that they didn't *ask* you what breed it was (though it's also possible they've had scads of people lying to them about it and aren't going to trust you on it).

Has management even laid eyes on your dog yet? I would take him up there and let them eyeball him. Could be that they will agre with the other tenant. Could be that they'll realize that your dog is NOT a pit bull and will let the matter drop. If you write a letter I would hand deliver it so you KNOW that they got it.
