Don't know anyone who had one and had it fail, although I'd bet it happens on a very rare occasion. I'm sure that would be huge grounds for a malpractice lawsuit against the performing doctor though..
I am sure there is some kind of paperwork that gets signed just for that very reason. The dr. performing the surgery would be an idiot this day and age not to have something covering his/her rear end!!

I'd love to see how much therapy the poor child would need after the parents sue for "wrongful birth".....not only were you unwanted, you were so unwanted that we needed big bucks to make us whole for having to have you....![]()

You can't sue the doctor. My DH had to sign a paper stating so plus if you go for all your check-ups afterward as the person is supposed to and everything is checked then there will be no chance of pregnancy.
My DS and DBIL are both doctors. You always sign a waiver...as I said though, you cannot waive gross negligence. Malpractice insurance covers cases of gross negligence on the part of doctors. Of course its your job, if you choose to sue, to prove gross negligence. Maybe you live in a state with different laws, but I'm pretty sure this one is universal for all states. If your offended by my assertion, my humble apologies as I certainly am not out to offend anyones sensibilities here. I am in no way advocating suing doctors either, just stating the law as it applies here in NJ and PA.
