Possession of Marijuana

Okay, Ky. criminal defense attorney here.... In most counties she should only receive a 30 - 60 day sentence probated for 24 months and pay court costs. They might make drug testing or counseling a condition of her probation. In some smaller counties they do require jail time, crazy as that sounds. If I was her, I would hire an attorney to take care of it. She is more likely not to get jail time if she happens to be in one of those crazy counties if she has a local attorney. Key word...Local!

My guess is she is going to be in big trouble with her job if she is in the education field. Good luck to your friend.

She is going to have some problems on the school front. When working with kids there are criminal history checks and disclosures.

She will if your area has a ARD acellerated rehabilitation Disposition....for first time offeneses that no injured party. But, the larger penatly is going to be the facing the music of the school system. If you read it in the paper, they did too. She has to disclose it, they will find out and it will be worse.

I don't understand when people are in the just say no, mentoring and position of influence on the kids, why they make poor decisions.
I also know that the courts are over filled with criminal and cival cases.
there has to be more than a possesion. Either there is suspected distribution, large quantites being purchases and possesed, or found in relation to another crime.

Just to stop someone and charge with small possesion is unheard of. That has to be a lowered charge, because of sympathy that she would lose teaching certification, or she gave names....

I do think it's strange that she was not charged with anything else. No DUI or any other traffic charge.


She is not employed by the public school system. She is an educator employed by a state-funded (through a grant) program - I'd rather not go into further details. Oh, and she does not have a teaching certificate.

The county she was arrested in is a smallish county where she grew up. We both now live in a large town about an hour and a half away, so most likely no one here will see that newspaper.

And after the move by mexico, it is only going to help prove the points aginst legalizing marijuana, or any other substance.

why you ask? because its probably only going to be a few months until stories of overdoses, or vehicle accidents start taking the news by storm, because with the de-criminalization of ALL forms of use, there is noting to stop people from smoking, inhaling, or shooting up their choice of poison 24/7, no matter what they are doing.

I bet the death toll goes way up in the next six months to a year.

Some people crying about Michael jackson? heck, just wait till the "spring break" crowds hit mexico.

and all the while, the public attitude will change.

It is illegal. My guess is, as a teacher, she will lose her job and possibly her career.


There's no way in heck you could overdose from pot. You would either fall asleep or eat so much that you couldn't move. But an OD.... no way!
