Really feel for the family regardless, I can't imagine what they are going through still.

Well he has a reputation of shining a bad light on anything cruise related. Not saying that he doesn't know, but I'd be surprised, if there was a settlement, that the information would be publicly accessible.
 
I am surprised that they won, that is quite a precedent considering that hotels are setup exactly like the cruise ships. Curious when this happened, it for sure never made the news of any sort. ...

The case was quite prominently in the news at the time, especially within the cruising community. It hit mainstream news outlets (TV, radio, newspaper, Internet), though admittedly I think it was just one of those quick little AP blurbs in the national section of our newspaper and easily overlooked. I can't speak for whether any given lawyer has "inside" knowledge or is just speculating. However, I wouldn't be surprised if Disney did or will settle out of court as I believe they often do, including a non-disclosure clause so terms of the settlement will not be made public.

It is speculation, but DCL now has lifeguards on duty any time the pool is open, presumably as a result of this incident. WDW has also been limiting pool hours, though that supposedly is driven by a couple of incidents at resorts as well as a FL state law requiring fencing. Whether DCL pool hours are directly related to this incident, or just indirectly as a cost-savings measure (lifeguards aren't cheap!), I guess it doesn't surprise me due to the cut-back on pool hours at the resorts as well. It is a bummer because my family loves swimming in the evening too -- it's a great way to tire kids out before bed! But on DCL we always seem to have plenty to do and an exhausted kid with or without swimming at night.
 
We were on the Magic last year and TOTALLY appalled by the pool hours. Our kids were 9 and 10 for reference. We are from the West Coast, so working on a later schedule. The family pool was closed from 6-8. We had late seating. So the only option for swimming then was the little kiddy pool (which seemed odd, as most families with little ones were eating at this time). Couldn't go swimming after dinner as they were closed. So our kids favourite thing, watching movies on the funnel vision from the pool, (especially evenings when it's not so crowded) was not an option...

In the meantime that's supposed to be one of the family "perks" is watching movies from the pool. They show it in all the brochures and videos -- and it is at night!
 
My opinion: 2 reasons not many people use the pools at night and because now that they have lifeguards they have to be the ALL the time the pool is open.
Don't think it's a $$ issue because they're paid whether they are at pool or not. and people are always in pool at night
 

It saves DCL on labor costs. Same reason they've cut pool hours at Disney resorts.
crew members sign standard contracts to be on the ship. Whether pool is open until 10 or 11, they are paid the same. It's not a cost cutting issue.
 
I believe this started after they hired lifeguards for the children's and family pools. The pools are closed when the lifeguards are not on duty. For whatever reason they choose not to have lifeguards on duty in the later hours. The adult pool has no lifeguards, so is open later.

You can still watch the movies on deck - but not while inside the pool.

It would be possible for a lawyer to know that a case settled out of court, even if the details of the settlement were not disclosed publically.
