Point Transfer/Rent Questions

I am debating over the next few months on whether to book our 2010 cruise with points or rent my points and pay cash for the cruise.

I went to the rent/trade board and read the rules. I have a few questions:

1. It says if you want to transfer points to another DVC member you cannot receive compensation (I haven't read all of my DVC agreement yet, we just joined). However, when I look throught the rent/trade board, there are several threads that say Points for Rent/Transfer and then they say they want $11.00 a point. Is this against DVC rules? If so, why do people do this. What happnes when they get caught. And, why, would someone give away their points without compensation (unless they are just super nice).

2. For those of you that have successfully rented out points, what are your rules? Do you require immediate, non-refundable payment?

3. How do you have other pay you?

4. Has anyone had a really terrible experience with renting?

To answer question 1, Have you ever driven your car faster than the posted speed limit? Sometimes you get caught and sometimes you don't. The rest of your questions have been talked about at length recently. Scan the threads and you will find out more than you want to know.

I don't have the Public Offering Statement here with me now, but it's in there. And if you haven't read the POS yet, might as well start now.

I have the POS in my hand now. This one must have come with our BCV points. Look under Home Resort Rules and Regulations. Part II - Using Home Resort Vacation Points. 5. Transferring Home Resort Vacation Points Between Club Members. 9) Club members are expressly prohibited from receiving compensation for engaging in any Transfer activity. There are 9 other statements regarding Transfers.

My personal opinion is that Disney doesn't really care if you receive compensation or not. They certainly expend no effort to enforce or even find out if there was money involved in the transaction. (Of course they have to know there is, LOL).

Again, my opinion - I think they put that statement in there for two main reasons:

1. Points have no value. They represent an ownership interest in a deeded Right-To-Use lease. They're on the record telling you that points have no value in and of themselves. There's probably a legal requirement for that statement to be in the POS

2. If there is a dispute over a transfer, Disney won't / doesn't have to get involved because they told you points have no value. Note that point transfers cannot be reversed.

AFAIK, there have been no reports of DIS members "defrauded" due to a point transfer gone wrong.

P.S. I have read a few reports of "super nice" DIS DVC members who have transfered a few points to other members in need without compensation. :)

When renting/transferring points starts cutting into Disney profits, then we will see other rule changes or enforcement. Until then the effort to police isn't worth the cost.
