Point transfer question

I have points that expire in Dec. 07 and I would like you opinion on transfer vs rent options.

I read on the board (sticky note) that points cannot be transferred for money? Why do I see offers on the board that explicitely ask for $$ when transferring points? Where is it mentionned in my Agreement with DVC?

Renting, on the other hand, does not seem to have the same restriction. As long as I agree with whoever is renting.

It's in the Public Offering Statement. I have one dated 7/2001. Under Home Resort Rules and Regulations - II. Using Home Resort Vacation Points. 5. Transferring Home Resort Vacation Points Between Club Members: 9) Club Members are expressly prohibited from receiving compensation for engaging in any Transfer activity.

By the way, under IV. Member Benefits and Privileges: 3. Making Reservations for Non-Club Members: 2) When a Club Member uses his or her Home Resort Vacation Points to reserve Vacation Homes on behalf of a non-Club Member, and the Club Member does not charge any rental or other fees to the non-Club Member for the reservatio, the non-Club Member is eligible for all or some of the Club Member privileges adn benefits that a Club Member would normally receive during his or her stay in the reserved Vacation Home. If the non-Club Member is renting, it is the responsibility of the Member to notify Member Services when making the reservation. Member privileges and benefits cannot be extended to non-Club Members who rent Vacation Homes from Club Members.

I finally found my "Condominium Rules and Regulations for the SSR dated 05/2004" and read it for the first time. At first it seems somewhat different than the one your have.

The use of the facility for "Commercial purposes" is expressly prohibited. However the term "Commercial Use" is defined as a "pattern of rental activity that the Association, in its reasonable discretion, could conclude constitutes a commercial enterprise or practice."

It seems to me that I could transfer/rent my points for compensation once in a while as long as I am not turning it into a commercial enterprise. Transfering/Renting points because I can't use them would hardly qualify as a commercial enterprise, I think. This seems to be a case by cases situation which would involve the association assessing the patern of activity every single time. Unless the association is willing to get burried in legal paperwork, it is unlikely to engage into assessing every one-off transfers that a member may do over the lifetime of the agreement.

I didn't post the part about no commercial activity. That's in another part of the POS. Everyone should have a POS. It's a small white booklet, about 5"x7".
