How should I go about resolving this ebay issue. I purchased a Disneyland sweatshirt that turned out to be not as described. I won the auction for 5.50 and paid 10.50 shipping. The sweatshirt was described as being in great condition. It arrives with no less than 10 stains on it. I did try but the stains did not wash out. How should I handle this? Should I just chalk it up to live a learn or should I try to get some of my money back?

I emailed the seller and this was her response. Notice she now describes it as good condition and no where in the description does she list that it has stains nor are there any visible in the photos.

"I am so sorry you were not happy with the Disney Hoodie. I described it as I saw it, used but good condition...there are no tares or wrips...yes it is used and may have a few spots on it from being worn...it is a white hoodie. I even posted photos. The only reason I sold it was I bought it one cold night at Disneyland for $60.00 and found afterwards it was a medium Mens' sweatshirt, not womans size so it was always big on me. I could have donated it to Goodwill but thought a Disney fan might want it so I went through the trouble of posting it on ebay.
I'm not sure for your $5.50 bid what more you had hoped for. Could you try washing it with Oxyclean? That may get out any stains or spots you are unhappy with. Most people wash items that others have worn before. I would suggest that before you give up on it.
I truly was hoping you would be happy with it and I am sorry you are not.
Again, in my opinion it is in good condition...and for $5.50 you can't go wrong. What more would you like me to do for you?"

I'd give negative feedback but otherwise let it go.
 
File with Ebay and say it wasn't as described. Or lesson learned...I learned early on that great condition or like new wasn't the same meaning as I thought. I ordered some scrubs that were "like new" and they were so old and worn I felt bad donating to Goodwill! I threw two pieces away.
 
Were the stains visible in the photographs? Did the seller indicate there were stains? The stains would be a dealbreaker for me. I would ask for a refund of the purchase price and the shipping, indicating that you spent considerable time and effort attempting to get rid of the stains and, for those efforts, your money needs to be refunded.
 

I don't know what planet this lady is from, but a white sweatshirt with stains is not in "good condition". I don't think I'd even donate something like that to charity; I'd either wear it to paint or do yardwork or around the campfire. I can't beleive she even insinuated she was doing anyone a "favor" by selling soiled clothing and then went on to throw in another stinger with the "what do you expect for 5 bucks?'

She offered no remedy for the problem, she admitted that she grossly misrepresented the item (even though in her twisted mind she thought she was in the right). I wouldn't hesitate filing a claim with ebay.
 
If I file with ebay for not as described, do I have to pay to send the item back? That would not be worth it to me as the shipping cost was more than the item.
 
This ebay seller is not an honest person. I have purchased much from ebay and most sellers are honest people. I would contact the seller one more time and give an offer on a resolution like payment back including shipping because the item was not as advertised. Period! I wouldn't accuse him of lying or comment on any of his explanation to you. He knows he is not being truthful and will get the point. He won't respond to you? Then post your negative response explaining why you are not satisfied. Be sure to make the point the item was not as described, and picture was not accurate to the condition of the item. Selling an item that is not as described is against ebay policy! He may or may not offer your money after your negative response. Negative response sometimes moves a seller to try to get you to adjust feedback later. That's what I would do. It won't take much of your time, and it can't hurt, and you're only being honest.

I didn't know that you can change your feedback if you leave a negative. I guess you learn something new everyday. Please tell me how
 
I think I would sent her picture of the stains that you are concerned about.

In the long run, I think a possible compromise will be the seller refunding the purchase price & maybe more with the agreement that it gets donated to goodwill as suggested. It sounds like that might be a more appropriate selling platform for it?!
 
Yes, if you want to send it back for not as described you have to pay for return shipping yourself. But I promise you it won't cost you $10.50 to ship one sweatshirt like what they charged you for shipping and when they refund you they have to refund you purchase price plus what you originally paid for shipping. So you will be out a few bucks but you will get back $16. I would also wait until the refund was issued then leave a negative feedback and not remove it even if they ask you to. Just because they issue a refund doesn't mean you don't have anything bad to say about their shady selling practices or dishonesty.
 
Message the seller back and let them know you want them to take it back and refund you in full, if they don't respond at all or don't respond positively, file a claim with ebay. I sell on ebay and I'm not supportive of filing claims right off the bat without working with the seller, but when the seller isn't willing to work with you that is what claims are for. You definitely would be well within your right in this case.
 
File a claim in the resolution center and ask for your money back because it was not as described. If the pictures show no stains and you received it with stains then you deserve your money back. You may have to pay for return shipping.
 
My favorite Ebay snafu was when I bought a used cell phone for one of my kids; with T Mobile you can just stick a Simm card in any T Mobile type phone.

So I had my son'd old Simm card, but there is memory on the phone itself, not on a photo type removable memory card. Well, when I tested the phone, before giving it to my son, I found a surprise. It was loaded with porn! I was able to erase the photos, but could not get rid of the videos. I contacted the seller, and she refused to budge said, too bad, it was my problem. Said it had been her son's phone. Very rude, abusive, then even told me to try bringing it into a local T Mobile to see if they could get the porn off. Refused a refund.

I KNEW she would have to give me one, and told her so. Then I told Ebay, she was selling porn thru Ebay, lol. And she had me so ticked, I left wicked feedback. "Sold me a PORN phone!!" People like me probably led to the Feedback changes. And of course I got a refund.


It is funny now, years later.
 
As all the others said, tell the seller you want a refund, and if they don't comply file with ebay. Personally, I would ask the seller to refund the purchase price and 1/2 of what you paid in shipping.

As far as shipping goes, most likely eBay will ask that you return the item and you will have to pay return shipping out of your own pocket.

If this item is going to California or a similarly far distance, it WILL most likely cost this much to ship. I know a hoodie in a package from my place in the Midwest to the coast would cost $10.25, if you use the USPS packaging. If you need to buy a box, it will be a few bucks more. I know my own PO no longer supplies the regular boxes, just the flat rate ones, and the medium flat rate box costs $12.35 to mail.
 
You can try and file a claim with ebay to force a return but since you already washed the item it is not in the "same condition" as when it was sent to you. Ebay may side with the seller. For $5.50 I would hope she would just refund to avoid the negative feedback. She doesn't sound like a very smart seller. I would e-mail her again to ask straight out for a refund and if she refuses I would open a case and see what happens.
