I would keep things quiet at work for now because it is easier to find a job when you have a job.
That's exactly why I haven't complained..much. I'm trying to keep quiet and just deal with this crap until I can find another job. Then it's see ya later and don't think I'm coming back(like a few other employees have..they quit/get fired and then a few mos later are back)!
First off, the break issue. Exactly what kind of break schedule do you get for your shifts and how many hours are your shifts. Doesn't matter what Texas says - you are working for a national chain and more than likely they have a company policy on breaks because it is easier to enforce one policy company wide that would work in all states instead of monitoring each state by their particular law. Do you know where he keeps his operations manual (if he has one there?). Usually the ops manual should be made accessable to all employees.
As far as break/lunch schedules..that's at the whim of the mgr on duty and/or the big bossman if he's there. I'm not sure what the company policy is as I cannot locate the manual I was given upon hire. I'm not sure if he has a copy in his office either and if I asked for one, he'd ask WHY I'm asking for it and I don't have a good reason for that. Saying I lost or misplaced it would make him suspicious I think. I don't know if he has an operations manual or not. I'm sure he does, but I have NO idea where he keeps it.
He not only touches you but pokes you? That is harassment. Find out your companies harassment policy. He should not be laying a finger on you like that especially when he is reprimanding you.
Oh he does more than that...he's also put his hand on my shoulder which totally creeps me out. I've emailed corporate asking about the harrasment policies (sexual or otherwise) and have never heard back from them which irritates me no end. He's also called female employees fat and ugly in the past. Not me, but another girl. I'm not sure if he was joking or not but if he was, that's not very funny.

The schedule issue sounds wrong for anyone working in a chain establishment also. Most places require their managers to submit a completed staff schedule to their supervisor at a certain time prior to that period. Not only that but they usually have "X" amount of payroll hours they can use per week. Not sure how he could stick to that if he leaves things open ended ALL the time. I can see during a special event or holiday where he isn't sure if he will need people for 4 hours or 6.
I think he can get away with not putting the schedule out until he feels like it because he is not only the GM but part owner of this establishment and several others in the area.
Big thing is for you to find out what your COMPANY'S guidelines are for all of this. Chances are he might be doing some major rule breaking. Do you know if there is an anonymous phone number you can call to report issues? Most companies have them because most people (like you) are scared to do things for fear of the backlash.
There is a number but I've never gotten th e chance to write it down because every time I go in the office either he or another mgr is in there and I don't want them to SEE me writing it down because they might say/do something.
This man makes me very, very nervous and I've been trying to get another job since about a month after I started working there and realized the kind of crap he's up to. But shortly after I started working there I got pregnant with DS and it's close to impossible to get a job while you're pregnant.

All I can really do is keep emailing corporate and telling them what's wrong. I have half a mind to ask all the Plano/Frisco DISers to go to the corporate site (www.SonicDriveIn.com) and make false complaints against him so that he'll get in trouble. But I know that everybody who did that would be lying, which would be bad. BUT he'd get in trouble and possibly get investigated, which would be good.
Oy..too many moral dilemmas to sort out.
