Out of control neighbors and now DBF in jail!!! (long)

Last Saturday we asked a bunch of Family and friends over to see the Disney videos and pictures from our recent trip
Our neighbors were out of town...but their kids...18,16,15...were home...
Because we were having the party we stocked our garage with alcoholic drinks for the cook out....later we went out to buy the food...and no one was home...
Upon returning we found our garage door open...and one of its windows broken....and what do you know...some alcohol is gone!:earseek:
We look over at our neighbors house...and who do we see sitting on the balcony having a drink....the 18 yo...

Thats trespassing, robbery, and breaking and entering!

Since people were already arriving...We couldn't do much...and by 6 everyone was there....the grill was going...and we were setting the videos up....
By about 9 every things was watched/seen....and we were all just hanging out...

By 10:00 our neighbors..and there friends (15 or so ) were getting really out of hand....loud music...screaming....cusing...
By 11 we couldn't take it anymore...we all decided to head to another party and didn't get back till around 3am...which by that time the party next door was over....

Sunday I woke up to vomit all around my backyard! :earseek: including floating in my pool and hot tub!! There were bottles everwhere....and part of our fence (seperating the two houses) was broken!!
Not only that but it looked like there was feeces in the pool as well!!
YOU HAVE GOT TO BE KIDDING ME!:mad:

My DBF went over there to get them to clean up their mess...and when they refussed...he said he was going to call the police...and when they refused again...he threatened to show the survailence tapes of the backyard and garage to the police!
When they refused again...he called the Police...showed them the tapes....and the 18 yearold was brought in for stealing the alcohol...and vandalizing our property....

Well today we just got a call saying that the parents of the boy are suing us for harrasment...and froud...claiming that he never stole a thing and it was all a set up! As well as assult and battery charges on my DBF...the 15yo boy said that he witnessed him assulting his older brother!
My DBF is currently in jail!!!!!

I spent the whole afternoon crying and trying to get in contact with my DBF...who truly did nothing!!

I have no idea what to do know!

I just needed to vent this out!

I'd probably call a lawyer.

BTW, how did they know you had liquor in your garage? This seems a little weird.
 
I agree, first things first. Get a darn good lawyer, FAST!
 

Did you call the police when you noticed your garage had been broken into? What about when the neighbors were making too much noise and drinking?
 
hugs - get a lawyer, I hope you get it straightened out fast. Just another sad example of parents who don't let their kids take responsibility for their actions. I work in a middle school and see it every single day.

They knew we were having a cook out..I had invited their parents...
Plus they saw us unload the trunk of groceries that morning

As for calling the police...I truly wish i did....we have had problems with these kids before...thats why we had cameras put in in our back yard....
At the time I wasn't going to call the police...only a case or two of beer was stolen...and the damage to the window was minimal...only one pane knocked out and the latched broken off...
I was about to approach them whe....like i said people started coming over....I thought I would confront their parents about it first anyways...
As for the noise...well i did call to complain just as we were leaving the house...they said they had had other complaints as well...
Never has it been this bad...

I just got off the phone with my dad who was at the station...he said that DBF will have a bail of $6000 :earseek: and can be released no earlier then 8pm tonight!!
We're talking to lawyers now...all of which say that the family doesn't really have a case...but with a good lawyer...anything could happen....

WHY ME!
 
Terrible thing, get a lawyer and never speak to the neighbor's again.
 
You said that you had invited the parents to the BBQ, so that must mean you are friendly with them. I would make sure to act civilly towards the parents and the kids, no matter how angry you are. Hopefully, the parents can make this whole thing go away with no problems. You don't want to tick them off. Just be careful with how you talk to them and what you say. Even though it's pretty obvious their kids broke into your garage, you have no proof. Good Luck!

I simply cannot imagine NOT calling the police immediately. They stole your property, broke your window and the latch and you didn't think that was significant enough to call the police?

I'm sorry you're having these problems, but your dbf should have never gone over to their house and taken matters into his own hands. Had you called the police and let them handle it from the beginning, all this could have been avoided.
 
Hey you guys have the tape on your side, right? How could that be a set up, is he saying you asked him to go into your garage and pretend to steal liquor? Those kids have issues! Hope everything comes out OK.

The second I saw the window broken and teh beer missing I would have been on the phone to the cops because it wouod have prevented the following issue with your DBF. Never let a break and enter slide that is the first mistake you made not wanting to naf on you but they may get away with it because of that. I hope everything works out for you.

Who called you to let you that you are being sued?:confused: How can a person get arrested based only on someone's accusation? :confused:

well i did call to complain just as we were leaving the house...they said they had had other complaints as well...

I don't care if your party was in full swing when you discovered the break-in. The time to call the police was then! And as for leaving my house at 11:00 because the noise next door was getting out of hand...well, I would have been too afraid of the vandalism that obviously occurred after you left. Your DBF should have let the police handle the whole thing instead of going over and confronting anyone.

1) We received a call from their lawyers...and recieved papers whithin hours...

2) Its one persons accusation (the 18yo)..plus the fact that the younger brother claims he witnessed it...since there was a witness to the "crime" they have the right to bring my DBF in and question him...since there was no other evidence supporting my DBF...they had no choice but to "side" with the "victim"!

I'm really kicking myself guys for not calling the police...Like I said...we do like their parents....and thought that getting them "busted" was not the way to handle the situation....I figured I would explain to the parents the situation the next day...and they could handle it...
Boy was that a mistake...thankfully our other neighbors came over to help pickup the yard and drain, re-fill the pool...
My DBF is home now...thank god....and is kicking himself like me...

We have a could chance of dismissing the case on the tapes...like you all said...theres no way we "framed" the boys....
as for the assault charge...DBF has a court apperance early next month...it has a slim possibility of beng "dismissed"...and though he may not have to serve time in jail...there could be major consequences
 
If you knew a minor had broken in and stole liquor and was drinking it you really should have reported it immediately.

Not just because they stole from you and broke your window - but in a way you are aiding a minor in underaged drinking and you yourself could have ended up in jail for not reporting it.

It was your alcohol and you didn't report it missing yet knew it was in the hands of minors - it could have been a lot worse than it is.
 
This is one of those situations where it's easy to see what should have been done afterwards. And a lesson for all to what to do next time a situation happens like this.
Frankly, I'm glad no one was hurt, because a situation like this could have ended a lot worse. I'm glad no one died.

"only" a "case or two"?? How much was there to begin with? And then everyone left for another party? And you left knowing they'd broken in and having had problems with them before?Never mind, these are just rhetorical questions. This boggles my mind! :confused:

First of all, 1. did they break the door or lock? 2. Did you leave the garage unlocked? Do you have a tape or wintess who saw the juveniles do this to your house? Why exactly is your dbf in jail?
