we have two contracts with 350 on one and 150 on the second. We are getting older and should do something in wirting for giving them to the adult 4 kids. I told my DH we should put two kids name on each contract so when we go they can decide how they want to do the split. Some one else said we should do a will and allocate the number of points in the will.But I am not sure how they would get Disney to split with points if left in a will.

any one know.

There are several ways you can do this and you may need to consult with your attorney for assistance.

You could add all names to both contracts and let the kids decide how to use the points or you could simply indicate your wishes via your will regarding how the points are to be used (this is the method we have used) or you could give one contract to one child and another to the other child. You will not be able to divide the points differently since an individual contract cannot be split up. I would consider just directing your intent thru your will and that way no additional costs would be involved for closing costs to change the deed.

How could that be done if all the points are in the same contract?
 
See then one of them would have to make sure that the maint fees where paid. I have two responsible ones and two will not. I would like to make sure that they have the points for each and responsible for their own. I know two will want to sell the points and get the money. Thus giving them the smaller contact. ..

In our case, our contracts will go into a trust via our will. The trust will continue to pay the maintenance fees and the points from the 4 different contracts at 2 resorts will be divided by the instructions in the will. I'm confident that our wishes will be carried out by our two daughters, both well into their 30's at this time - but basically, since we will no longer be around to worry about it - we don't really care what happens, it will be far beyond our control at that time. :)

If you have children who would rather NOT have the benefit of the DVC membership then it may be best to address that specifically thru your estate in some other way. Since the DVC contracts cannot be split up to leave each an equal number of points you may be able to place a "value" on the points and give that "value" to the children who do not want DVC in some other fashion. I understand the issue, but when everything is said and done - your estate will have a "value" and all you need to do is find a way to distribute that "value" (or it's equivalent) as equally as you wish.
