Perhaps it varies by state/county then. We have had several clients who receive SS and cannot be garnished nor can their bank accounts be frozen.
 
Either way you cut it, the government wants their money back and if there is anyway they can get it they will.

Social Security is a federal program, not state/local, so state/local have no say. I agree that state/local may not be able to garnish, but the federal government certainly can, and will.

Not to cut the paper to thin, buts its our money, not the governments. If you don't pay back your student loan, as far as I am concerned, you get what you deserve. It was borrowed in good faith, it should be paid back.
 

They should do whatever they can do to people who don't pay their taxes, including locking them up.
 
If you owe the federal government money in any form (student loans; IRS; etc.) they can and will freeze an account that is funded only with Social Security.. The same holds true for court-ordered child support payments..

No one else can freeze or garnish Social Security..

Um, I think the subject is Student loans not taxes.

Didn't Former President Clinton try to get people to work for the Peace Corps and then they wouldn't have to pay their student loans.

WASHINGTON - The Supreme Court ruled unanimously Wednesday that the government can seize a person’s Social Security benefits to pay old student loans.

Retiring Justice Sandra Day O’Connor wrote the decision that went against a disabled man, James Lockhart, who had sued claiming he needed all of his $874 monthly check to pay for food and medication.

This could have a big impact on those baby boomers who are about to turn 60 and who didn't repay their debts.

(WASHINGTON) -- America's seniors and disabled cannot escape old student loan debts, the Supreme Court ruled Wednesday, freeing the government to pursue Social Security benefits as part of an effort to collect billions in delinquent loans.

The Bush administration had argued that the ability to withhold Social Security benefits is an important tool in the pursuit of $5.7 billion in student loan debt that is over 10 years old. Overall, outstanding loans total about $33 billion.

Government lawyers said there is a limit on how much can be taken from benefit checks, 15 percent, and that the Education Department can forgive debts in some hardship cases.

The unanimous decision went against a disabled 67-year-old Seattle man who lives in public housing and had sued claiming he needed all of his $874 monthly check to pay for food and medicine.

James Lockhart's benefits had been cut by 15 percent to cover debts he incurred for college in the 1980s. He has about $77,000 in unpaid loans.

The court's decision applies to loans that date back more than 10 years, and covers both disability and retirement benefits under the Social Security program.

Senior citizens groups did not know how many elderly or disabled people could lose some of their monthly checks if the government decides to go after them.

"It means that you can take the Social Security benefits of someone who is 90 years old and living on a small amount of money," said Brian Wolfman, director of the Public Citizen Litigation Group and the lawyer for Lockhart. "The losers are clearly older Social Security beneficiaries."

Lockhart lost earlier at the San Francisco-based 9th U.S. Circuit Court of Appeals, which said that Congress in 1996 eliminated a 10-year time limit on the government's right to seek repayment on defaulted student loans by seizing Social Security. The justices affirmed that decision.

Other lower courts, however, have ruled in favor of Social Security recipients, and Wolfman said that Congress could reconsider the issue.

The Supreme Court was called on to clarify federal laws that sent conflicting messages about the collection of old loans.

The ruling was written by Justice Sandra Day O'Connor and will probably be one of her last. She is retiring after 24 years.

Looks like some folks on SS that didn't pay back their student loans are going to be in BIG trouble..

You have to wonder though.. If the student loans were for college - and college provided them with a better job - shouldn't they have had the funds to repay those loans? Or maybe it's the college students who racked up $100,000 in college loans and then decided to become beach bums.. :confused3

It's going to be real tough going on them - that's for sure - but it is what it is..
 
I am nearly finished with paying off my student loans. :cool1: For those deadbeats, I think you are scum. You are hurting others who need this type of assistance to get through college. And I LOVE how this can catch up to you later in life. So glad Social Security can still be garnished. I think jail time is a great idea as well.

Scum is a pretty harsh word to describe someone that doesn't currently have the means to pay off the debt. People get sick, people lose jobs, etc. If someone isn't paying because they absolutely cannot afford it, I wouldn't call them scum.

There is a difference between someone who can't pay their obligation and one who won't pay their obligation (deadbeat). There are ways to get help with your student loans (foreberance, etc.) Anyone who is having difficulty in paying their student loan should call their lender ASAP!

If you don't have the means you can ask the loan holder for a deferment/forebearance or reduction of payment. Heck a couple of months ago I got a deferment notification in the mail because the US Dept. of Education thought my area was affected by Hurricane Wilma (it was not, and I have continued to make payments).

i must say - i agree with mj's assessment of deadbeats.
 
Actually, the man in this article is 60-some odd years old and unless he was disabled right out of college, there should have been some point where he could have been paying and then made other arrangements when he did become disabled..

On the flip side though, if he is disabled, living in low-income housing and doesn't have any other assets, taking the 15% of his SS could actually drop him down to an income where he would get more assistance from welfare.. So, technically the federal government would be taking money away with the left hand - and the state and federal would be giving it back to him with the right..
 
I'm just glad that I paid mine off on time. I paid my grad school loans off way early. I hated having payments.

40 years ago when these loans were fairly new, the government was not so great about enforcing repayment. I think that there are a lot of older people who think they've gotten off scot free. Wow are they going to be surprised.

Until this thread I was not aware of the Supreme Court decision in December, so I can imagine a lot of people don't know about it yet.

Certain types of student loans can be discharged in bankruptcy, typically only those owed to the school directly.
haa haa haa, well I have the receipt right here and have been paying for 2 years now FROM my SSDI. so think again!

I agree. There will be many people who are in for a big surprise when they find out that they still have to pay for there loans even after all these years.

I'm aware of that. I'm saying that they should treat the same as they do people who don't pay taxes.

I agree with the others who say these people have the opportunity to make their case in they can't pay. Those deadbeats who make no effort to do anything should get locked up.
