Need some help with visas!

Gosh, We didn't even realise about this one. My brother in law came with us to US in October 2001 and he has had a good few convictions in his past. He didn't have a VISA so I assume he put no convictions on his form. I hadn't even thought about it until reading this thread!!!! We must have been lucky.

Does the fixed penalty (paid straight away) for drinking from a bottle in the street (outside a club waiting for a cab!!) count as an arrest????

I'm pretty sure it doesn't count. I think you at least have to be taken to a police station for it to be an arrest, possibly have the "you have the right..." statement read to you as well.

Well were going to look at a copy of the ordanary visa and see what it says. His offences might not even class as a conviction so my family think. Will it state on his police records weather it was a conviction or not?

it should do, a caution isnt a conviction, I think for it to be that it has to go to court. As I said before I had a caution when 12 years ago when I was 14 and when I had criminal records bureau check done it came back clean and the caution had been wiped, if it had been a conviction it would still have shown on there. I have also travelled to the US many times and never had a problem.

Well I hope it is the case. We really dont want problems at customs. Ive been to Disney 6 times any never had to even think about anything like this! Now im thinking about it that much its making my head hurt lol. I will update when his police records come in the post, fingers crossed that wont be long now!!! At least we have given our selfs pleanty of time to sort all the details out!!!!!
