Need help for accident at MK last night....any help/suggestions on where to turn?

It's too bad the last few pages were turned into a debate. I just hope the "popcorn oil" family gets everything taken care of for them. I was thankful to hear that no one was physically injured. Hopefully they can still enjoy whatever is left of their vacation.
 
Any word from the OP.

Hi everyone

I drove down to Orlando yesterday to enjoy an overnight trip to Universal and to see my sister again since it was their last night in town.

Sis and family met us at Citywalk and we enjoyed our evening together.

Although they have filed the paperwork with guest claims, they left Disney this morning (Thursday) with no pixie dust!

They checked out of the hotel this morning with full bill. Not that they were "expecting" any of the hotel bill to be comped, but that would have been a nice gesture. Especially since sis had spoken to another guest on the PO bus who stated she got a night at Riverside comped b/c they usually stay in the mansions but were put into Alligator Bayou and this guest wasn't happy at all about that....so that lady got a free night. Good for her (I guess) but sure didn't make my sister feel any better.

To answer the question posted earlier....the CM who was responsible for spilling the oil was very apologetic and immediately called for assistance. She had some rags on hand and immediately began cleaning my nephew and my sister off. The CM threw away my nephew's oil covered popsicle (my sister actually had to ASK for that to be replaced as they went to go shopping for dry clothes)
OTHER GUESTS were helpful to them on the bus. Other Guests escorted my sister and nephew back to the room from the bus, so I guess you can say that Disney Magic definitely lives, but apparently moreso in those of us who enjoy Walt's legacy than for some of those who are employed by the corporation.

I will keep you all posted.

I for one would like to know how Shannon's sister's predicament turns out without having to LOCK this thread before it comes to a conclusion.I'm sure many are waiting to hear how this ends.

Let's cut out the debating and get back to the subject of WDW and it's theme parks.

Shannon...let us know when you hear something.I'm hoping your sister and family have salvaged their vacation and are having FUN again after having this HORRIBLE thing that happen to them.I'm hoping this MESS has been taken care of and they're back to enjoying some Disney Magic !!!:earsgirl: :earsboy:
 

So guess what happened?? Everyone involved,,,every waitress that even offered their coat, was subjuct to appear in front of all lawyers in deposition and made to feel as they were criminals!!

I have to ask - did this go to a trial w/a jury or was it settled out of court? I'd bet money you answer it was settled out of court.

Unfortunately, insurance companies often want to settle rather than take even some obvious claims they'd almost certainly win.

I worked for a large company and 2 contractors did something they were told NOT to do. 1 was injury fairly bad (out of work for about a year) and another moderately injured. The later guy settled out of court for 40k. The 1st guy didn't as he wanted a lot more. We took it to a jury trial and didn't have to pay a cent. Talk about a dejected Habush & Habush ambulance chasin attorney:D

I came late to this gathering and suggest the following:
First instinct when there is an incident, SHOOT PICTURES AND VIDEO , DON'T WORRY ABOUT THE QUALITY!
My son had an accident at MGM , and we didn't shoot film until the boy was in the ambulance headed to Celebration Memorial.
I videoed the area of the incident and after my son came home from the hospital photographed him.
The WDW Claims Rep at WDW gave me a hard time with compensation until I sent the video and snapshots.
They did compensate for the medical and lost time on our trip.

Plus video everybody, staff,EMTS, everything, After watching the video at home weeks later I discovered more than at the moment of the incident.

Well I'm sorry to hear Disney didn't come through,with a little "jester" at least! :( Hopefully they'll get something done through Guest Claims.With all they've gone through Disney has not treated them with the first class customer service I thought they prided themselves in.:(

I feel really bad for them.

Disney Magic definitely lives, but apparently moreso in those of us who enjoy Walt's legacy than for some of those who are employed by the corporation

I'm afraid that is the truth...the Disney Corporation is in a sorry state right now.Hopefully that will be corrected soon.

I think DISers believe in Walt's legacy and I KNOW there are so many here that still believe in Disney Magic!

Yeah, we talked about the taking pictures thing...last night at dinner they were talking about how stupid it was of them to not photograph themselves. But also how that isn't the first thing that pops into your head.

My sister also laughed and told me she was so tired and oblivious at the time that it happened...she said the main thing she remembers is this girl shouting, "Omigosh, send help, Oh, I'm sorry" right next to her (the CM calling for security/assistance on her walkie talkie)

My brother in law was actually just out of sight (I think he was throwing trash away at the actual moment of "the incident") and as he saw them, he said he just froze in shock. You just don't expect to see your family coated with thick yellow oily grease.
He scooped up their daughter out of the stroller (she didn't get the brunt of the spill) and when he knew that my sis and their son were being "cared for" by the disney people, he went ahead and left the park with the baby to get her cleaned up and in bed.

So, anyway, yeah...they did have a camera on them, but they didn't think of it at the moment. AND I guess that CM wiped a fair amount off of them very very quickly.

I do want to add that my sister has several times stated how very sweet that CM was...sis was not upset with her because the CM who was involved with the oil spill was so sweet and so nice (and young) and she just doesn't have one bad thing to say about her.
 
Shannon-- I think your sister needs to be commended for her behavior. She is truly handeling this all w/ a level head. I honestly can't believe Disney has yet to offer her just a little something more. I read a lot of posts about people trying to really get something for nothing from Disney. In this incident, I think the family truly does deserve replacement of everything, plus some compensation for the "whole mess". Hoping that in the end everything works out for them. Keep us posted w/ whatever details you can.

Kind of like the story in the news I remember a few years back about someone who died in front of a hospital because the employees were not allowed to treat him outside!

Shannon, if you're looking to sue, just do it. Otherwise laugh about it since no one was hurt. It was an ACCIDENT.

[Side note: It's not her, it's her sister.] I can't speak for anyone else, but for me, it's not the incident itself that would tempt me to sue, it's the incredibly poor reaction to it. Totally aside from any "magic" that could have been worked (which doesn't necessarily have to cost anything or very much), at the very minimum, their ruined possessions should have been replaced with comparable items.

I'm really sorry to hear about this other incident, Lori, but it sounds like the Manager wasn't just "throwing a dog a bone" but trying to compensate you for what was obviously inappropriate behaviour by the other CM. Will sueing WDW make you feel any better? I'm just saying maybe there is a more pro-active approach. That said, maybe sueing will ensure this doesn't happen again? (Litigation like this doesn't happen in Canada!)

Shannon - glad to hear things are a little better with your sister. From the other posts it sounds like if your sister thinks she deserves her stay comped (and I think she probably does!) then she should just ask for it. I've worked in the hospitality sector before and often these requests are granted if requested. However, if someone doesn't ask for it, usually it doesn't happen.

I can't think of any nice way to say this....but isn't
this sort of action by the poster what everyone is
complaining about. One rude person and your going
to SUE disney? Thats ridiculous.
 
Have to agree with you there. Can't imagine anyone wanting to sue Disney or anyone else because one of there employees was rude.

Appears to be part of their mentality.....her husband took "several weeks" getting comped the first time. And then spent on hour and a half in City Hall when they encountered the rudeness.

Getting back to the original, ongoing story, I noted the husband left the Park before the incident was fully addressed, leaving his wife and one other child there on there own. If I had done like that, I'd be missing some parts shortly thereafter. Guess she's pretty tolerant!

I AM NOT A VINDICTIVE PERSON AT ALL AND HAVE PONDERED THIS SITUATION CAREFULLY. I AM ONE OF YOU A GREAT DISNEY FAN AND STILL WOULD LIKE TO VISIT IT DESPITE ALL OF THIS.
