Need bankrupcy advice please!

My parents filed bankrupcy last year. I'm not sure of the number, but it is the one where you repay your debts. Anyway apparently my dad only made a partial payment a few months ago, and now he has to go to court. Any idea of what will happen?

He needs to call his lawyer. I am sure they'll explain what happens.

I am not a lawyer and all states are different.

If the Chapter 13 payments were not made to the Trustee, then I believe the Trustee can ask for a dismissal of the Bankruptcy, which means any assets, like a car or house can be up for grabs for judgment and foreclosure. Also he would have no protection from the creditors.

I think if the means test can be passed, a Chapter 13 can be converted to a Chapter 7.

Your Dad needs to get his attorney on this asap and not mess around. This is quite serious.
