need advice with ebay scam- help!!

I recently had to report a seller for not sending my Illuminations CD that I paid for. The check cleared my bank on July 14th. The seller Fourparks claimed he never got my payment when I asked what was taking so long. Then I emailed him and told him that he cashed the check and it cleared my bank on the 14th of July so please send my CD. Finally I had to report him. Now he has reported me as a no pay. What can I do? This is so wrong! I paid way more than I should have for the CD to begin with and now I am not going to get it? Besides the fact he no doubt will leave negative feedback and tons of lies when it is all over with. What is Ebay's policy? Will they, can they help or intervene? This is happening way too much lately with sellers cheating me. I am to the point good deals or rare items or not I am not going to buy from Ebay cause there is too many crooks and sickos. Thanks for letting me vent. And please does someone have an answer to my problem?
 
I have been using eBay for almost 8 years and never had a problem. The one person I knew who did reported the incident to eBay and everything was cleared up. Have faith in them and get a copy of the cancelled check and all the emails, etc... so you can present them to eBay when the time is right and they will take care of everything. It just takes time so be patient.
 
Thanks for the quick response. I wonder why some people have to be so nasty and pull stunts like that. Just because I wanted my CD which I already paid for he has to sent in a false report on me. Doesn't Ebay frown on fraud reports? People like that shouldn't be able to sell or participate. I checked into his feedback after the fact- live and learn. He really worked some people over. He is vicious, and really mean. Yet he has sold numerous items. Who can figure?
 
If you don't get your cd, PM me and I'll send ya one. I bought three of them on closeout from disneydeals to ensure anyone I got hooked on it had one! After spending 19.98 for one, it felt weird paying what I did for three total.

As a eBay seller I can tell you that eBay has a dispute resolution program. There is a link on the buyer and seller page. Negative feedback can be jointly lifted also. Hopefully just sending the seller a copy of the cancelled check will resolve the issue. If the seller is trying to scam you, sometimes the "threat" of action is enough for him or her to "suddenly" come to their senses. Good luck and don't give up! Always check feedback before bidding!!!!!!

Eclectics- lesson well learned. No matter how high a number they have I will check out their latest feedback, and what feedback they leave for others.

Guess I will have to be patient, and with luck he will be "honest" once I send him a copy of the cancelled check. Sure irks me to have to go through all this when I was honest and sent in my payment right away. I pride myself on that. It is sent out the same day or at the latest the next day.

Ouch! It could be worse, though. some guy put up what he listed as IllumiNations discs. I noticed that it said 'selections include some of the following', and then realized it was the free one that CVS gave out that isn't the whole thing!

I'm obsessed, I have both versions of the disc! IMO, the one with the Tapestry of Nations is better.

Im sure it will work out and please don't judge the eBay community by your bad experience. The majority of us are honest pleasant folk that will go out our way to resolve any disputes. Sorry you had to get a "bad egg"!
 
I can not believe the nerve of this guy! This rotten so and so actually reported me as a non pay. What kind of a nasty evil person am I dealing with to play a game like that? Takes my money, refues to send my CD makes it more inconvient by making me wait and send a copy of my cancelled check. Now he reports me as a no pay! Man am I burning!!
 
Do you have online banking?

If so, you can go to your account and see where the check cleared and they will have a scan of the check and the signature. You should save that to your hard drive and send it to the seller and ebay.

Great suggestion! I had to do that because my LANDLORD insisted that I didn't pay last month and security. Unfortunately, I'm working with a lawyer now to recoup my money. However, Landlord can't report anything-when you're new on ebay, those negatives can kill you!

Thanks. That is a great suggestion. One problem though. I don't have online checking. Sure wish I did. I have to go to the bank and pay for a copy of the cancelled check. They charge me for a lot of things. I've been with them for so long I would hate to have to start all over with another bank. I seldom need anything from them were they would have to charge me. This transaction is starting to cost me way more than it should have. Oh well....

No. He just recently sent me a message stating he hasn't recieved the copy of the cancelled check yet. He is now playing games as if I don't have one and I am the corrupt one. I responded and told him that I unexpectly ended up in the hospital and was just released, but as soon as I could I would be sending the copy. No doubt he will play off that as if I am a lier and wasn't actually hospitalized. To be honest I don't care. I just hope to eventually get my CD from him. I spent way too much for it so I should get it.

I am so burned up. This rotten swindler now made a final value fee credit claim. From what I am gathering he not only gets my money, but doesn't have to send my CD, and he gets a credit on top of all this? What on earth is going on here?

I emailed him telling him I was just released from the hospital and would send him a copy of my canceled check as soon as I felf well enough to go to the bank for the copy. Now he files this credit thing, and I get a strike against me. I get a strike and no CD!! I am so mad!!!!!!!!!

I am sending a copy of the canceled check to Ebay, but good will this do? I am under the impression that this transaction is closed now. Or is it?
Any suggestions, advice is appreciated.
 
I don't believe Ebay will get involved if it goes beyond 30 days of the transaction. And if the check cleared on the 14th, that would make me think that you're SOL. You originally posted this on the 11th. I'm sorry that you had to go to the hospital, but if you were having trouble with this, you should have tried to give it a higher priority (I really DO apologize for being blunt about it).

I would call your bank (you don't need to go in) first thing on Monday am and request the copy of the check. Most likely they need a day or so to find it, so I would call them first.

If you can show the guy the cancelled check, he may send the CD. And he may not... Sorry!
 
Have you reported him to Ebay? You might also check out some internet fraud sites and see if he could be reported for this. A seller did this to a bunch of us who bought from her and several reported her to the fraud agencies. Not sure how it turned out.

That is why I like to use my credit card, if there is trouble like this you can dispute it and get a credit back.
 
ksjayhawks: yes, I did report him. I have also been in contact with another Ebay member who he has cheated recently. She also has reported him. A fraud agencies was my next step. I hate "playing dirty" and going that far, but since he has no problems playing dirty I guess I shouldn't.

He got my money, a final value fee credit back and of course he still has my CD. Not right.

jfulcer: To be blunt with you. I feel my health is far more important than a CD or contacting that scoundrel. My priorities in this case were correct. I recieved an email from Ebay and they said that they were going to look into this since he has a track record. Maybe all talk but we will see. I am sending a copy of the canceled check to him and Ebay. This way Ebay can see who was in the wrong. As far as calling my bank I already did. They said I have to do is come in to prove its me.
 
I don't know who the seller in question is, but are they a powerseller or do they sell a LOT on eBay. If so, it's possible that the seller received your check with several others, deposited it, and made a mistake in their record keeping and never marked your auction as paid for. Even so, that doesn't excuse them.

Another problem is your unexpected hospital stay. I've browsed on eBay's message boards and you have no idea how many sellers say they have late-paying or non-paying bidders with self/spouse/parent/child in the hospital excuses. I'm not doubting you, but the seller probably read your e-mail about this and thought "yeah, right."

I second what jfulcer said. Get a copy of the cancelled check and scan front and back and e-mail to the seller as proof. Give the seller a week. If the seller still won't send you your item, contact them again and tell them you plan on filing mail fraud charges with the USPS. I wouldn't say anything about that when you send the check scan; hold that in reserve, and if they refuse even after seeing the check scan, tell them you plan to file and do it.
 
Thank you Matthew. Will do. And yes, in answer to your question he is a power seller. He goes through a period when he is gets a lot of good feedback, but often the buyer says in the good feedback that it took a long time to get their item. And when some poor soul does give him negative or neutrel he has the same whiney yadda yadda speach about defaming him and the buyer having no qualms in doing so.

Trying to communicate with him is a ordeal also cause he is foreigner. He writes in broken English if thats makes any sense.
