The estate is in trust does that make any kind of difference? I know that there won't be any probate issues because of that (at least that is what I am told).
The will does state that the property is to be divided 3 ways - between us three girls. Can't sisters can 't fight that can they?
I am in MI as well. I deal with Trusts in my job often. So if he has a Living Trust, you are the Successor Trustee, that is different in some ways than an executor. The fact that there is a Trust will make it very difficult for your sisters to try to sue the estate. If he only had a will you would have much more difficult of a time because it is pretty easy in MI to dispute a will. A trust on the other hand is a different matter entirely.
When your dad passes you will have control over the trust and its assets to distribute as he outlined. It is very likely, depending on the amount of assets, that you will want to consult with the attorney who created the trust. Trusts are very comprehensive in their instructions. Good recordkeeping and organization will help you the most. The fact that they created a trust was a very loving thing to do, especially considering how your sisters are.
