my MIL fell at disney

On thurs night we were walking out of the park after wishes and she tripped over the curb and smashed her elbow , broke her arm and is presently in surgery. My DH stayed behind with her but we all (dh mil 2 children and my mother) had flights out friday. We had to cancel both their flights. The disney people have kept in contact with her and its under investigation. The woman said she knows the area is a dark spot (before you walk out the turnstyles the curb is black to match the street, the people stand on the train platform waving) and she said to keep all recipts. Has this happened to anyone?? Can anyone give me an idea what will happen?? We missed out on our last day of disney , my children were both crying their eyes out because granny is in the hospital, they didnt even want to go to the park. It really put a dark spot on our first disney trip

thank you for your well wishes. It was really hard getting the kids home without DH but we made it. My DH was in tears (he's a Marine who NEVER cries) saying how horrible he felt for his mother. I really wish this didnt happen.

I am so sorry that your MIL got hurt.

One of my friends was telling us about their Disney trip 3 years ago. Their daughter fell off a little step and hit her head on a trunk that was being used by a performer. Disney paid for the cost of the medical treatment, gave the whole family new shirts, (they were covered in blood) and gave them another day's park admission, and transported them to and from the medical care facilty.

I hope your MIL recovers quickly. What a terrible thing to happen on your first trip. I would have been sad for her and my kids. I don't mean to offend anyone, but I don't think that Disney should be responsible for anything considering she tripped and it was an accident. Is there personal responsibility for anything anymore or is everything a handout or a law suit? I am not saying that you are, I just don't think I would look for someone to DO something for me or wonder what might happen if I had an accident on their property. Then again, this has never happened to me and there are plenty of sharks, I mean lawyers out there who would love to give you some advice. I personally would chalk it up to bad luck or being so tired from a day at MK that she she just fell. Anyone else ever been falling down tired? I am very clumsy and fall all the time. I just don't look for something to come out of it except that I am sure to do it again.

Anyway, I do hope she is better soon and I hope I did not offend you!
 
One good reason to carry travel insurance. The park should pay medical, same as if you fell in front of a grocery store, or a delivery person fell on your steps at hoe, homeowners cover itl

I hope that your MIL recovers swiftly, and that the bad memories fade for the children become fewer and new ones can be made on another trip.
I do think with all the fiber optics and lighting there are several areas that need addressing at the park.

I know I triped once and scraped bad but did not seek treatment, just bandaided myself up.
Once years ago at Dorney Park in Allentown at thepool and water park area, someone through a lit ciggerett on the ground and in my bare feet stepped on it and got a nasty burn, ruined our day. They took a report and did nothing more. Not even a half refund for the loss of the day.

Another unsafe area is Hershey Choc world ride, the brick steps as you exit are bad. The ride is going around the platform is not, but the experiance is the motion is still going., As I hit the step I tore my toe nail off. Took the report and never contacted me again.

In Walmart shelves had double pack buckets of citronella about 3/4 inch over hang on the third shelf up. One fell on my daughters instep and broke a bone. She was in a soft cast for a month. I took pictures of the shelf with my cell phone and a manger ran over to make me erase it. NO WAY. They tried to say it was in her hand and dropped it. The cashier told them NO, she was looking at items and had something from another shelf in her hand.

They did finally pay for it....that was all. Not even a rental of a scooter for a local trip when she could not walk.

Micky d's I bite into a hamburg and hit a bone, brok a molar into three pieces. They wanted the hamburg and I sent it, they said they found no other bone particles and would not pay the dental work. I filled a small calim and the woman called saying they would pay as it would cost more to send an attorney up to the hearing.

Gosh are we accident prone?

Okay, maybe I don't understand where the line in drawn between personal responsibility and owner liability? If you have an accident on private property and it is your fault, the owner of the property is liable? Do you have to find a reason to blame them or do they normally do SOMETHING to make you go away? Just wondering.......... Sounds like big business for all parties involved. We have a farm and an employee that lives on the property. I might want to call my insurance office Monday and check into this. My employees are real winners. No money 2 days after payday and they don't even have any bills or expenses! Just lots of beer and cigarettes!

Thanks to TheFlame for calling me and those in my profession "sharks" -- it warms my heart.

As for personal responsibility vs. business responsiblity: If Disney knew it was a dark and potentially dangerous spot, then they could, and should, be liable for any and all expenses. (I am not licensed in FL so this is not legal advice but just a discussion about my thoughts on torts.) If this was a true accident the outcome could, and should, be changed.

For those of you who have asked about personal liability and/or have asked what happened to personal responsibility, let me ask this question of you. How would you feel if you were invited to a store, and the store knew there was a giant hole in the middle of the floor but they did not tell you about it? This despite several customers who had previously fallen through the hole and injured themselves. You, having a reasonable expectation of safety in the store, didn't see the hole, fell, and broke your arm. Would you expect the store's negligence in not notifying you of unsafe terrain to be your fault? I would think not. :)

Do I think, as a whole, that personal responsibility has gone by the wayside? Yes. I think the world could use a HUGE dose of personal responsibility. However, in this instance, we just don't know enough to make any type of conclusion and we shouldn't be quick to judge that personal responsibility is missing in this case.

Again, to the OP, I hope your MIL is doing better now and that y'all can remember more positives than negatives from this vacation. :)
 
I'm not expecting for disney to hand over the keys to the world, just give my mil a hand if she needs it (maybe help her with transportation to the airport) My DH has been sleeping in the room with her. I wouldnt sue disney , accidents happen , but I do find a few flaws with the area she fell. First of all the curb is black , the same color as the street. They really should put reflective something there so people , especially tired ones,can see it. The CM wave from above the train station, distracting you from where you are walking. I noticed all the other parks they are in front not up above. Plus , its really a dark area in the park, even the claims lady said that. Hopefully they will address it so no one else would fall like this. My DH said they get tons of disney people a day (talking to the nurses in the hospital) I"m sure some are out for blood, I'd be fine with medical bills paid for my mil in a timely manner. I've heard some say they've got day passes for lost park time , but being in new york a day pass would be useless to us.
Kinda depressed today, It's mothers day and i'm all by myself with my kids. My neighbor brought me flowers after she heard which was really sweet.

Unfortunately, yes. That's why I don't let the neighborhood kids skateboard in our driveway.
 
We were at Disney two weeks ago and my Mother fell as well.... It had been raining and we were walking over one of the slippery wooden bridges, she was wearing flipflops. She fell and it knocked the wind out of her. Luckily, we were leaving for the day and no permanent harm was done. It was really my Mom's fault for not wearing proper footwear...
I'm glad you aren't the litigious type. I hate when people see accidents as a lawsuit waiting to happen...and my DH is an attorney!
 
I must say, this has been one of my biggest complaints with WDW. After dark, most of the lighting is AWFUL! I feel like I am half blind most of the time, kind of fumbling my way around. They really need to do something about their night time lighting. JMHO.
