REMEMBER ... don't tip your hand to him when you pick up the kids tomorrow!

Def.. whatever you do dont get into a discussion of who, what , when, where etc.. Just pick the kiddos up and get the heck out of dodge.

Now... for some reason GOD FORBID that he doesnt show up, what happens then? Do you have a game plan?

At my son's school they don't spar until green, which is after white, yellow, and senior yellow. 2-3 classes per week, with 3 months between belt tests usually. It may be different for the adult class.

Love the bubbles!

Hope all goes well at pickup.

I would call in the am to make an appt asap with their counselor! Does she do Saturdays?

I so agree with this one. I wish you would have had an appointment made for when they came back from Ex's then that would show the judge that you were not planning on having them spend the week. I think you should have an Appointment scheduled every sat if available or monday after they come back from Ex's

LOVE THE Bubble idea!:thumbsup2

I PROMISE- No words to him. I'll be fine.
IF he doesn't show up- DAMM has till 6:30pm, if he fails to show and has not contacted me or the PD then I will call the state police and give them the Troopers name from last week and explain the situation and go from there. The trooper PROMISED that if DAMM does not return them TONIGHT AT 6PM, they will call the Judge and get a 'contempt warrant' and the children WILL BE returned to me TONIGHT!
Just pray that nothing goes wrong! PLEASE!
On a happy note, the kids will be so excited to see the new vehicle and I got them a portable DVD player to velcro onto the back seats for them:thumbsup2 :cool1:
I will just tell them how much I missed them this past week and just let them talk- I'll have the recorder with me.;)

No Saturday appointments. But I'm trying to get them one for Monday.

Glad to hear #2 lawyer agreed with #1's advice.

I agree with the others - if he shows up today, do NOT talk to him about anything. Do not let him see any reaction from you whatsoever. Don't be upset if the kids seem angry with you or sad, etc---know he has probably told him goodness knows what --- and that they are too young to really grasp it all. You can take care of whatever he's said/done later - just get them to your car and leave. Take the high road on this. Definitely do not give him any idea of what you have going on regarding court.

Be ready for ANYTHING at the pick-up point.

I can't wait for you to be with your kiddos again. Good luck.

Hi

I totally agree, do not speak to him at all, just smile as soon as you see your cherubs, smother them in kisses and hugs and get out as fast as you can, dont look back , just go, dont show any emotion other than sheer delight to see your cherubs, and if it all goes pear shaped then do as the police told you , but EVEN THEN dont get angry and I know that will be sooooooo hard but remember little eyes and ears are watching your every move, take care and i hope when i get up tomorrow morning i will be able to read good news,

totally agree with everyone about 4th july, listen to your lawyer . and keep schtum at all times.

take care

Guys- I need help once again. Here is the letter that I am suppose to send to DAMM- I tried to keep it along the lines of non-confrontational, but to the point....edits please! Remember, JTB will probably be reading this letter too!

DAMM,

This letter is to inform you that the children will not be at the 1/2 way Police Department on Friday July 4th. Due to the recent stunt you pulled by not returning the children last Sunday and then lying to Trooper X as to a 'supposed' agreement between us, my attorneys have advised that all visits cease until we go back to court on July 14th.

As in the letter sent to you prior, my attorney has recommeded that communication reguarding visitation be handled via email. Any changes to the schedule must be given at least 24 hours in advance. Again, this email account is for the purpose of communicating visitation and nothing else. In the event of an emergency my cell phone number XXXXXXXX

My email address is XXXX@XXX.XXX

I may consider rephrasing it a little and taking out "stunt". That makes it feel confrontational to me still.

If I were you I would replace stunt with details of how he didnt give you proper notification for the 5 week visit and then he kept them over his scheduled weekend visit. Also the last line should have In the event of an emergency when "damm" has the kids to call. :) just my personal opinion. I think the wording "the recent stunt you pulled" seems confrontational. Good Luck!!!

Definitely change the phrasing about "the stunt you pulled" - that is confrontational (although it is TRUE!) to something a little less abrasive.

I think your attorney needs to advise you on EXACTLY what to say in this letter and how to phrase it.

Be the bigger person here - don't let any hint of anger or bitterness show in this letter since you know that JTB will be reading it and will nail you to the wall if anything is remotely out of line.

Ok, you're right...how about this?
DAMM,
....Due to the recent event of not returning the children as per court orders last Sunday, my attorneys...

1) I'd replace the phrase referring to a "stunt". It sounds petty. I think I'd refer to the "incident that occurred last Sunday when you didn't return the children as agreed upon and lying to Trooper X about an agreement between us that never existed."
2) reguarding is spelled regarding.
3)Any changes to the schedule must be given at least 24 hours in advance and agreed upon by BOTH PARTIES.

Dear Ex:

Pursuant to my attorneys' advice I am sending this letter to inform you that the children will not be at the police department on Friday, July 4, 2008 for visitation. My attorneys have advised me that since the children were not returned to me on Sunday, June ___, 2008 that all visitation should cease until a court hearing can be scheduled. You should receive notice of this hearing in the near future.

Also, my attorneys have advised me that all further communication should be addressed by email. My email address is xxxxxxxxx. This email account is solely and exclusively for communication regarding visitation. Please do not use this email account to communicate regarding any other subject.

I think this should be it. Do not tell him you know when the hearing is, wait for him to be served to find out. Also, he never got the first letter. You bringing that up may make the judge ask what happened at the police dept. and that doesn't need to be dredged up again. You also should not dictate when modifications should be made and why give him the opportunity to do so. This is not legal advice, only my personal opinion. I do not practice family law. (my disclaimer)

No accusations, only facts.

Go with Momx2's letter. It sounds very professional and leaves emotions out of it.

Good luck!

DAMM,

This letter is to inform you that my attorney has recommended that all future communication between us regarding visitation is to be handled via email. I have set up an email account solely for this purpose which will be checked daily. The email address is xxxxx@xxxxxxx.xxx. Please note that if there are any changes in the visitation, 24 hour notice must be given.

My attorney has further advised that due to recent issues with the summer schedule visitation, all visitation will cease until a court date can be set and our visitation schedules can be straightened out.

Thought this my help. Looks a little more legal. Straight to the point. Good luck!!!
P.S. I have a degree as a paralegal if you ever need any advice on legal wording.

Mr. so-and-so (or To: First Last Names)

Please be advised that (children's First Last names) will not be at (address of PD) on Friday, July 4th 2008. Due to your failure to show for your extended visitation on (X date) and your failure to return the children to their custodial parent on (X date) while withholding communication, my attorneys have advised that there be no more visitation until the case is brought to court (don't put a specific date, let the court papers serve that).

Per legal advice, all communication regarding visitation will be via email at (email here). Any changes to the visitation schedule must be given at least 24 hours in advance, as noted in the court order. The email account is solely for the purpose of communicating regarding visitation and for no other purpose. In the event of an emergency, authorities are to contact me immediately at XXXXXXXX.
