Heard on my local news station that the family of the young boy who died on MS is suing Disney. One thing the news reporter mentioned was that the family was upset that WDW let such a young boy on the attraction... huh?

Honestly, no one can be blamed here.. The family cannot be blamed.. the boy was the required height... They had no knowledge of his condition... His doctors didn't even diagnose him with this condition.... Disney cannot eb blamed because they are not responsible for the health of their guests...

A 4 year old should not have been on it.. but, if he was the height required, then no wrong doing there by the parents.. Maybe the height requirement is too low (Disney's negligence then)... Maybe disney needs to put a higher requirement on the thrill portion... Or force families to take their kids on the tamer version... make an age restriction on the thrill version...

yep.. Disney will be taken to task again, recieve bad publicity again for M:S, and have to shell out, what i would assume millions to this family... The family lost their son.. cannot replace him.. all that money will not make them happy, for they lost their child.... This is just the end of a sad string of events...

I pretty much agree with you. Except to say that even if he fit the height requirement, that would not absolve the parents per se. It is still a judgement call by the parents to some extent.

And her judgement, based on the fact she thought the child was healthy, was he could ride it... I don't see any reason to blame the mother.. Nor do I find any reason to blame Disney.. Personally, I wouldn't put a 4 year old on that ride... but that is me...

Do y'all think they'll shut down the intense version over this? I was sad about that little boy.I don't know if they should sue,I mean if you have a heart condition and you go on that ride it's almost an automatic death sentece.I don't think extra height would have help that much cause of his heart.I'd like at least one more investigation but in the end I think it was his heart that did it and the whole height thing wouldn't have made a difference.

Probably not. I think just offering the mild version is good enough. However, if they find the mild version is vastly more popular, and I don't know if it is, then that changes everything. But considering the boy's health, it will be very hard to convince a court that the ride was truly to blame.

That report does not offer anywhere near enough information to pass judgement. So I will leave it at that

No one could really have an educated opinion as to who is right and who is wrong if anyone at this point.

There will be an investigation as a result of this. No one here knows the extent of the case, except from this rather void-of-details report. Let's please not come to the defense of the company simply because of the who the company is.

We should, however, expect the normal "America is Lawyer Obsessed" straw man argument.

I don't have children.. but I do have a 2 year old god-daughter.. I can only imagine what the family is going through... I would never want to go through that, and I would not want to see anyone go through it... I do agree that we need to wait to hear the facts of the lawsuit first... My son will be 5 when we go down there in Sept. He is tall enough to ride it.
1) I won't let him ride it, he's only 5.
2) He wouldn't get on it anyway.

Some parents just need a little dose of common sense. That poor little kid wasn't "mature" enough to know what the hell was going on there. It probably just became "to real" for him and he wigged out. Heck, I'm over 30 and I had that happen to me on Terminator 3D at USO, and I'm not scared of nothing. I thought I was having a heart attack, and I'm in perfect health (give or take a few pounds ).

So no, I'm sorry, Disney should not be liable for nothing here. If the parents want someone to blame, they can blame themselves. There's no way IN HELL that I would have put my 4 year old on that ride. Period.

The height requirement would be based on the ride's need. A rider needs to be x tall in order to fit properly in the safety features of the ride. The height requirement has nothing to do with age of the rider.

If Mission Space did have an age limit; I'm sure parents would "lie" to get their underage kid on the ride.

Gosh, we have quite a few 11 year olds come to the movie. The parents know darn well they are lying to save a couple of bucks admission. We also have quite a few walking and talking 2 year olds coming to "Cars" free.

One day the kid is 11 to save $2.00 on admission; the next day they are 17 to see the "R" rated movie.

It really needs to be up to the parent to decide if their child is old enough to ride the ride.

Even at Disney... A LOT of 11 year olds are suddenly 9 years old when it comes to buying tickets.

Funny story - at an undisclosed location, Kids 3-9 must be with at least one adult of a certain age to get in - and while i get the exact number, it was still under 16 basically.

I had two girls come up and ask for two kids tickets, and I asked where their adult was. They said they were going in alone. I explained the policy, and they left. No more than five minutes later, they come back asking for one adult and one child because the other girl "forgot she was old enough" - but luckily, I got to deny it, as we go by the first age we were told, not the "oops we forgot" age.
