I am a bit upset about my realtor's response to what has happened and am thinking about changing to another real estate agency. Anyone know if I can and if there is any penalty?

Im not sure, did you sign a contract?
My best friend has her house up for sale and has a contract signed for six months, if it isnt sold at the end of that time she can switch agents. It is a million $ house though, so maybe with big money houses that is the norm :confused3 .
I remember signing some sort of paper work when we put our last house up for sale, but dont really remember a time frame on how long we had to keep the agent. We werent anywhere near the money my friend has lol, we were about 900,000 short of that :rotfl: :rotfl: :rotfl: :rotfl:
 
Oh Kathy, how frustrating! I am so sorry. I hope another buyer with FINANCING comes through soon-after all the stuff in the past few weeks!:hug:

Lorie, just wait till 38 hits!!! I had NO idea my late 30's would come so quickly! I think this has something to do with the fact I can't tell other people ages very well! I think I should be 30-ish or younger sometimes!:laughing:

He's sleeping now, but in the morning I'll ask my husband. He's a realtor with Prudential.
 
And I hate to freak everyone out, but I just read that there in now a Tropical Storm Gustav in the Caribbean. :sad2: It needs to stay away from here and Florida since we're headed there in 10 days.

This thing scares me, it's predicted to be a Cat 3.:eek:
 
Good morning all!

Ive been checking on Gustave too.. got up with hubby at 4 am when he left for work and looked at him and just checked on him again a few mins ago.
Its at least a cpl days away I guess before we should get into real panic mode, but Im gonna go round up the flashlights and see what I need for supplies. I dont have alot of meat in the freezer either and was going to do a big run in the next day or two so I will put that on hold also till we know more about his path.

Oh hell no, that thing needs to stay far, far away! :eek: I know it's very unlikely for it to just fizzle out at this point, but hopefully it could land in a rural, unoccupied area.

Funny, DH bought wicks for the hurricane lamps yesterday because I couldn't find them when I was preparing for a possible power outage during Fay the other day. I hope that wasn't a bad omen. :sad2:

Crapola! I just went look at that forecast! That five day cone is not looking very good! I guess I'd better go get some batteries & get both my propane tanks filled today.

:confused: Just days away, and you find out now that the finances are not going to happen! This would be me.....:headache: ...the rest aren't polite enough to post here! Did the agent think to suggest having them put $$ down to prove they're interested (I can't think of the official term)? And why the heck did she even go forward if they weren't even fully pre-qualified. I hope Jan can pass along some solid advice. I'm praying this means there will be someone more deserving who will be able to afford the home. Stupid mortgage crisis!

Kathy, I agree on this. Your agent should have known whether or not they had the financing secured. There should have been a deposit & they would lose that if they didn't follow through for whatever reason.


Jenny, I'm wondering about Jack's day too!

Oh yeah, if we gotta go, I'm determined to go someplace that we can enjoy! Never again do I want to sit around in a dumpy hotel, with tons of depressed New Orleanians!

How many people can we fit in a value resort room anyway? :laughing:

Jack's day went fine! He was happy as a clam when he got home.
Im just worried about him catching up, but im guess it will all work out. The 1rst grade teacher knows she will have to play catch up a bit with him. Her class has already been going to school since Sept 7. Jack just started Kinder on the 18th.
and then we will be gone for 7 days starting Sept 10. :scared1:
If I would have known he was gonna be in First grade and not kinder I might would not have scheduled the trip.

OH well

I hope Gustav goes away!!!

Hmm, its usually not a prob here in Denham Springs, my only concern is the big trees around us. I have friends without big trees in their yard, so ill prob just check with them on staying at their places. The house we are bought didnt have electricity for about two weeks after Katrina, so Ill be sure and stock up on all forms of batteries, candles, etc!
Dh will be working Wed and Thurs of next week so we would be alone and thats not fun in a storm, been there done that and not interested in that happening again!
He can NOT take off during storm.. Exxon has to have workers on property no matter what. Ick!

Kathy, I think you or Johnny should speak with your agent.

If the deposit was named in the purchase agreement without any stipulations and buyer just plain backs out then thats breach of contract. However if the Purchase Agreement says contingent upon financing then they can backout with loosing the deposit. Provided they have a letter from the finance co. stating they did not qualify. Then all bets are off.

p.s. I've always understood the deposit would go to the seller.

I'm thinking that $$ should be yours. Small consolation for having the home off the market for so long. I really don't know the legal obligations, but I'd fight if that realtor tries to get any of it.

Since Lori probably won't want all of us crammed into that Value Room together, some of y'all may decide to head west on I-10. If needed, just know we're right off the interstate if anyone needs a potty break (of course, that's as long as DH decides to stay put!)

Jenny, Glad to hear Jack came home happy! Did you tell the 1st grade teacher about your trip? Did she think he could handle missing more classes.

Alexis' teacher acted like a *!*!, when Chris brought up vacation in Oct. Chris got scared & told her it was a family reunion! ;)
