I was always surprised that Carolyn Bessette Kennedy's family could file a Wrongful Death lawsuit against John F. Kennedy, Jr.'s estate and win, not only for her death but also the sister. It's not like JFK, Jr. did it on purpose. He miscalculated. He died too.![]()
The wrongful death lawsuit was a civil lawsuit based on JFK Jr.'s alleged negligence in operating the plane that crashed. Intent is NOT a component of a negligence case. If he did it on purpose, it would have been a crime. The defendant in a civil negligence case can be held liable for their "miscalculations" or mistakes, even though they didn't do it on purpose.
I have heard people say when discussing accidents, it was no one's fault, it was an accident, but actually in a court of law fault for accidents is apportioned all the time.
