Major problems with VR ( long post)

I am beside myself. For the last three years I have been working on getting a new adaptive van with VR assistance. I raised money, jumped through all the hoops and passed the driver's pre-tests last year. Meanwhile I already drive an adaptive van but the testing is a prerequisite. I was supposed to have the driver's training ( 10 hours) set up with a vendor. First the vendor told me he would not allow my service dog to be in his vehicle. I fought that all the way up to the PAC in Tallahassee and they agreed that I was right. This process took 6 months. Then I kept waiting to be contacted by the vendor, emailing my VR counselor every 2 weeks, who kept telling me to be patient, that I'd be contacted. Finally I'd had enough and contacted the advocacy center again. They agreed that I'd waited far too long, investigated the problem and found that I'd have *never* been contacted as VR wrote a contract for 3 hours of training and the vendor refused to sign for less than the 10 hours he recommended. So once again, their mistake and I've paid for it by waiting ONE YEAR total for any progress.
Meanwhile the A/C went out in my van, I now have a transmission leak, and engine block leak. I asked VR to pay for the repairs as it's their fault I've waited a year. I have the $$ saved for a downpayment but cannot use those funds to repair my old van, partly because those funds were raised for a new van and are in a trust fund, and partly because even if funds were released, then I'd not have enough $$ for a new van. I was denied, then I asked for a denial in writing so I could appeal. I was then approved for at least an assessment of repair costs (wonder how that magically happened?). I have heard nothing more about whether or not they'll pay for repairs and this was last week.Also, I drove for over an hour in the grueling heat to get the assessment only to find that VR had sent me to a repair shop that wasn't w/c accessible.
Finally I was contacted this week about the training but was told I'd have to drive to a van shop that is 1 1/2 hours from my home. I told my counselor I was not going to drive that far in a vehicle with no a/c and failing parts. They arranged for a transportation service...BUT, the service will not take my SD, so here we go again.
To make matters worse, I got home tonight and found an email from my counselor who contacted Access Lynx here in Orlando and stated that since I'm eligible for public transportation, VR will no longer provide services. So...they are now refusing to pay for the adaptations on the new van that they approved and that I've been saving for telling me to take the bus.
I am furious. I know this is passive-aggressiveness on the part of my counselor as I know she got in trouble for her part in the delays over my SD and over the approved hours where she botched the approval. I also know plenty of disabled individuals who live near me, could also "take the bus" and for whom VR has provided funding for an adapted van.
What would you do? Call a lawyer? Call the newspaper? I definitely want to expose what VR has put me through all with public tax dollars.---Kathy
 
I personally would do contact a lawyer and see what they have to say. If they won't do anything I would get a hold of a TV news show and have them jump to your cause. I know here in Michigan, many of the local TV news programs go to bat for things like this.

You might want to see what the ADA has to say about this too.

I'd call a lawyer and the local TV station/newspaper. I just happened on this post and I think it's terrible what you've been through. Don't give up until you get a decent resolution to this! :hug:
 
Can you find a lawyer that specializes in disability law? Around here, some will do pro bono work.

I can't imagine being told to take a bus, after all the work you've put into this. Don't even get me started on buses. My brother takes one into work each day, to save money, but he has to budget double the time it'd take in a car. Plus, he has to walk a distance to his final destination.

I realize you're in a wheelchair, plus the Florida Heat, plus keeping your service dog hydrated...have they lost their minds?

A lot of times it's easy just to cave in, and try to deal with what they give you. It's tiring and frustrating to deal with confrontation. But I hope you don't in this case---grrr!!
 

You have done your part, it is definitely time to contact and lawyer, you state, and federal legislative representatives and the media.

the problem solvers do investigative report type stuff with News channel 6 in Orlando- ( Steven Cooper, Tony Pipitone etc..) I would call them or Fox 35 -

(don't bother with channel 2 as they LOVE to twist stories and not present all the facts (sorry for the rant there..)

I'd also be calling some type of state rep as in senator/congress person-and I would keep calling until you got the correct repsonse. I would be the squeaky wheel...

My advocate in Tallahassee with VR CAP is just as disgusted as I am and is having my case moved to Orlando as well as requesting an administrative hearing against my counselor. Does anyone know if VR can be sued for "damages"? I guess I should call a lawyer to ask that question. I don't want to step on any toes that would prevent progress being made though, KWIM?---Kathy

I would concentrate for now on getting your van--just be careful of signing any documents that can be construed as "waivers" of any damage claims you may be entitled to.
 
I don't know about your state but here in Rhode Island we have a Disability law office it's free and they are just the most wonderful people I ever met. They have helped me out twice no charge and they worked real hard on my case
 
Just an update. My advocate in Tallahassee determined last week that I could no longer work with my counselor due to her gross negligence and incompetence. Proceedings are taking place against her. Meanwhile my case has been transferred to the Orlando VR office and I've received an email from my new counselor. Hopefully he can expedite my driver's training. My current van is now having problems starting let alone the leaking engine, transmission, no a/c, and odor of gasoline. I am pushing them for either repairs or the provision of a rental van as it's their fault I've waited a year now for the training and thus the new vehicle. ---Kathy
