How does Disney know who can stay for Magic hour? Do they kick you out somehow? Do you get a pass or something?

They scan magic bands for ride access when EMH starts. You can stay without a band. You just can't ride anything.

Morning emh- only on site guests can scan to get in the park. If you're offsite it'll light blue

Evening emh- guests enter through FP entrance for rides so you scan the FP head and it lights up green if on site.

You're not forced to leave the park during emh if you're offsite, but you won't be admitted into any rides
