Looking through the new documentation...pool hopping not mentioned

Most timeshares (but not all) do not allow members to use the facilities unless staying at the resort. Some have sister resorts and share fascilities and activities. Some do allow owners to use facilities year round but WDW is a little different than Aruba from a volume standpoint. Being an owner at a specific resort, no matter how large or small, has absolutely nothing to do with this discussion. What's important is being a DVC member who was staying at another resort and pool hopping.

I'm pretty sure Disney isn't going to bite on the idea that pool hopping at other DVC resorts is open season, even if staying at sister resort on points. Even if they took away ALL PH, I wouldn't see it as an infringement on my contractual rights so count me out of any lawsuit. Good luck though. All lawsuits must occur on Disney terms, in Disney area courts and if you lose, you must pay their expenses.

Oh oh....Disney is in trouble now. We're gonna whip up a $500K pot of cash against a mega _BILLION_ dollar company. Seriously now...why is this so hard to understand? Grab your DVC Member Benefits Guidebook and read page 9. Mine is dated January 01, 2001. It clearly states..in English..in paragraph one that we have pool hopping rights. Then immediately below in paragraph two, that the "right" and when you can USE it is at DVD's SOLE discretion. There is even more clearly worded disclaimers which further restrict those "rights" in the last 2 paragraphs. (I'll gladly transcribe and interpret them for those unable to do so on their own). So...anyone still wanna pony up the sawbuck to fight this one?

Actually, my impression is that there is a precedent for Disney backing down when members threatened action. Originally, Disney offered free park passes when you purchased a DVC membership. The contract said that the free passes were to expire at the end of 1999.

In 1999, Disney said that only points from your 1999 use year qualified for passes; points borrowed from 2000 didn't get passes. However, some wily members studied the language of their contract and concluded that they were entitled to passes any time they stayed in 1999, regardless of where the points came from. Disney hemmed and hawed, but eventually backed down.

So there.
 

Sorry if I misunderstood what you meant regarding sueing Disney. In my mind I equated collecting/gathering money, hiring a lawyer and class action (Normr) with sueing. Obviously, I am not a lawyer so if I misinterpreted what you said, I apologize. As I said in my post, I think any idea of sueing Disney is excessive.

I read on this thread that several of you have talked to MS about this question. Has anyone ever talked to their guide? I would think they would be able to get the answer from the horses mouth easier than MS. It seems we have all done lots of speculation without trying to get real answers.

I think the point of the posts is not what MS or different guides say, but what the documents say. Problem is, you seem to get different stories from everyone you talk to. Even the guides can't seem to agree on the policy. And has been stated many times here, you can only believe what's in writing, not what someone tells you.


That's my REAL frustration in this whole matter - Disney's inability to communicate something which (at least on the surface) seems so simple.


 
A question like this is exactly why DVC should have their own board up and operating. I can't imagine why they haven't done that yet.

I cannot see DVC allowing a discussion like this to happen on a board that they run. In fact, because of the legal issues, I expect that if (and it's a big if) they do eventually open a discussion board, the discussions will be very limited in topic and content.
