Lawsuit against RCCL

Just happened to glance at the TV this AM and saw a short piece concerning a lawsuit (or lawsuits) recently filed against RCCL regarding that fiasco with the Anthem.

As I was in a restaurant at the time and the TV had no sound, I wasn't able to get any details.

Anyone else seen or heard of this??

Yes. Short version is someone filed a class action lawsuit basically saying that RCCL knew or should have known about hurricane conditions forecasted for the route they took. Problem is that with all of the hype, hurricane force winds were not part of the official forecast. Hurricane force winds start at 75. The forecast was for winds up to 50. It's the same thing that came up in 2011 and 2012 off the cape. The weather forecasters got it wrong and everyone blamed the cruise lines involved.

Wind speed aside, it was pretty clear that the storm was predicted to be a large and violent one. Prudence and common sense seemed to be in short supply at RCCL.

My thought is that RCCL was not being especially nice or generous--they were probably hoping what they offered would avoid lawsuits and the attendant publicity associated with them.

Yes there was 3 or 4 other ships heading to the same area from the same port and Md.

The problem with the weather people are having and I'm not defending RCCL, just looking at the facts as they are, is they assume that every cruise should be flat seas and anything over 3 feet and the ship is in danger. The ships are designed for 40-50 waves. Uncomfortable yes. Dangerous no. I'll have to get to my laptop, and pull the official NWS forecast for the day before and the day the ship sailed. It doesn't say anywhere in there 100 mph winds which is what they got. 50 was the max. Tonka's Skipper and I were pming back and forth about it. This goes for any cruise line out there but there not going to call Al Roker or the Midwest storm chaser and ask what the weather is like where there going. There going to go to the NWS and NOAA and make a decision. It's not the first time that NWS got a forecast wrong and a ship paid the price.

My thought is that RCCL was not being especially nice or generous--they were probably hoping what they offered would avoid lawsuits and the attendant publicity associated with them.

I would agree with you. I think they were trying to smooth the waters (pun intended) with their refund and offer of 50% off in the hopes that people wouldn't sue.

If-- as you say-- RCCL was totally blameless, they should try to get this lawsuit into court as soon as possible so it can be tossed out as unjustified and frivolous-

To me the coastal warning was meant more for commercial fisherman and the average boater. It's not to say a ship capt wouldn't pay attention.

I doubt you'll see it go to court. RCCL will try and settle out before that. Even assuming that they did nothing wrong, ot still looks bad publicity wise. Even if they win. To a major corporation the sooner it goes away the better. Disney does it all the time. How many times have you heard that Disney is being sued. How many times have you actually seen them in court. It's a relatively small number. The people who bring the suit are generally bought off for lack of a better term and there's usually a don't come back clause. Even if the comp is 100% in the right.

As far as looking at storm avoidance that's pretty much standard and what I would expect. They'll look at all of the factors and see what of anything could be done differently. If this truly is an out of the norm circumstance and there really was no 1 thing that says the storm will be so big and 100mph winds on this date at this location, there's nothing that really can be done differently. On the other hand if someone has a piece of paper that says hurricane force winds etc, and the Capt knew or never got the info, then something will change. One of the things I did see when I was fact finding is that the people who look at marine weather are now looking at what role the gulf stream may have played in the issue. The thinking is the Gulf Stream may have influenced the conditions way more then what was originally thought possible.

True. It's a 50/50 shot of it going to court, and this will be brought up for time to come.

Please don't take this wrong, but from everything I've seen, it's people that have no knowledge of maritime build techniques and what ships can and cannot handle that are being listened to. Squeaky wheel thing. It would be in RCCLbest interest to layout a timeline to settle things down. Al Roker wasn't on the bridge with a forecast and neither was I or any one else. But I seriously doubt that a Capt of a new billion dollar ship deliberately put his ship into harms way. They can refuse to sail or put a ship into harms way if corporate says to, like Tonka's Skipper pointed out. Lime Capt Klink of the Concordia found out incompetence is not an excuse. Today its a different ball game much like the US Navy culture is different from 20 years ago. They don't put up with much.

Like I said, it would be in any lines interest to say this ship can handle theses given conditions and this was what was forecast for the route they took.

Even if it is frivolous, the insurance company will settle. I had a 70 year old woman file a lawsuit against my restaurant because she fell in the parking lot over a curb. How/why did she fall you ask? Because she was walking backwards trying to take a picture of our building and didn't see the curb behind her. The group of people with her said it was her fault and they settled anyway. It's generally cheaper to settle than go through the courts.
