Have the Gosselin children ever done any tapings without either Jon or Kate present? I have watched all of the shows with Jon there but we dropped cable since they've divorced so I haven't seen any news ones. I can't remember one episode where there wasn't a legal guardian present. Am I forgetting one or has there been since its just been Kate?
I don't see how that new rule will affect them any differently.

There are a few other examples over the years where the kids were filmed for a few minutes without a parent present. Petty stuff, and we don't know how often it happened or how long the kids were left with the crew unsupervised.
But do check out the recent episode called "Kate's Night Out." Actually, you don't really need to see the full episode, just look at and listen to TLC's promotional clips.
The episode aired June 6, 2011. Kate was filmed in NYC with her BFF (the blond whose name I forget) and her "body guard." There were a few pap photos of Kate in NYC filming the "club" portion of the episode the week before Kate's actual birthday.
Supposedly, while Kate was having her hair done and going to a club in NYC, the kiddies were (amongst other fun activities) sliding down the stairs in sleeping bags while they were (TLC states) supervised only by Ashley. The baby-sitter. Fun, but not the safest activity!
Ashley's legal temporary guardianship status - or not - is completely nebulous at this point. And, as the new legislation requiring a parent or guardian on set has yet to pass, it a totally irrelevant point. That will change if the new Bill passes. It requires a Guardian on set and the Gosselins will have to provide proof.
Of course, the Gosselin parents "should" already have a temporary Guardianship set up for when Kate is out of town and Jon does not have custody. Easy enough to provide that info to the State and make provision to have that designated person present on set when Kate can't be there. No big deal. Any responsible parent would find the requirement sensible.
But if they don't and haven't designated a Temporary Guardianship, isn't it, in the vacuum of information we have, pragmatically, a bit worrying? One wonders what would have happened if (heaven forbid) a Gosselin child injured him or herself sliding down the stairs or getting injured in any other activity without a parent/responsible party present. I truly hope there was a parent present - or someone (Ashley or anyone else) on that set had temporary Guardianship status - when that stuff was being filmed. The new law will cover for that, at least while the kids are working, if the Gosselin parents can't be bothered to take the responsible initiative themselves.
Of course, I have to ask, was Kate really in NYC when that footage of the kids was filmed? It is certainly possible that the footage of the kids sliding down stairs was acquired when Kate was home approving and personally supervising this activity.
But if Kate were actually home when that was filmed, that would mean that the whole "story-line" of Kate going to NYC and clubbing to celebrate her birthday while the kids were having fun with Ashley is fake.
A lie. Not "real." Just fodder for gullible viewers.

ETA: INF Daily has a new story (6/16.) Kate was filming yesterday with Mady and Cara in DC. The Tups were being filmed at home at the same time. No parent at home with the Tups, but camera and crew in evidence. Was there a legal guardian present?
