As the wife of a victim of child sexual abuse, all I can say is that this absolutely horrifies and saddens me:

SIDNEY, Neb. - A judge said a 5-foot-1 man convicted of sexually assaulting a child was too small to survive in prison, and gave him 10 years of probation instead.

His crimes deserved a long sentence, District Judge Kristine Cecava said, but she worried that Richard W. Thompson, 50, would be especially imperiled by prison dangers.

"You are a sex offender, and you did it to a child," she said.

It sounds to me like if he had to go to jail he might REALLY have gotten justice. He might have had a taste of how the child felt.

These judges who deal with child sex abusers and do stuff like this make sick. If they ever have someone close to them suffer from being abused, it might change their minds on what these people deserve.
 
That has to be one of the dumbest rulings I've ever heard, assuming there's not some other underlying reason behind the sentence. :sad2: :sad2:

I guess it's ok to be a molester if you're small enough? :furious:

How on earth did she get a spot on the bench? :confused3 I'm just baffled by this ruling or should I say the reasoning for the ruling. Unbelievable. :furious: :sad2:
 

Now that people know his name, what do you want to bet that some justice finds him? He deserves prison... and no soap on a rope either.
 
Oh please! That has to be the lamest excuse I have ever heard for not sending someone to jail.
If I did that, they'd still throw me in jail and I'm only 4'7". And a small person can still protect themselves. My dad is short for a man too and he's quite strong. Many people don't realize how strong he is because of his size and he constantly amazes people with it.

So, this judge must have another reason for keeping this criminal out of jail.

That is absolutely unbelievable. I am disgusted at the judge’s decision. :sad2:
 
There is no one tougher than short people... we HAVE to defend ourselves!

I think this sends a message to all short pedophiles to move to NEBRASKA! :furious:
 
I watched a Dateline about internet predators last night. A disproportionate number of them seemed to be quite short. I wonder why. One was probably a clinically diagnosed dwarf, and he had a number of charges against him. He was well below five feet.

Child molester too short for prison, judge decides






SIDNEY, Neb. (AP) - A man found guilty of sexually assaulting a child has been given 10 years of probation by a judge who said the man is too small to survive prison.

District Judge Kristine Cecava of Cheyenne County sentenced Richard W. Thompson, 50, Tuesday on two counts of sexually assaulting a minor.

"What you have done is absolutely inexcusable," she said.

Thompson was sentenced on two counts of first-offense sexual assault of a child. A third charge of sexual assault of a minor was dismissed. The assaults were on a single girl who is a relative of Thompson's, said Cheyenne County Attorney Paul Schaub.

His crimes deserved a long sentence, Cecava said, but she expressed concern that the 5-foot-1 Thompson would be especially imperiled by prison dangers.

"Can I make other children safe from you?" the judge said. "You are a sex offender, and you did it to a child."

But, she said, "That doesn't make you a hunter. You do not fit in that category.

"I'm going to try to put together some kind of order to keep you out of prison."

He will be electronically monitored the first four months of his probation, and he was told never to be alone with someone under age 18 or date or live with a woman whose children were under 18. Cecava also ordered Thompson to get rid of his pornography.

He faces 30 days in jail each year of his probation unless he follows the conditions closely.

Cecava declined to comment Wednesday night about the sentencing. Schaub also declined to comment. Thompson's attorney could not be reached Wednesday night.

As a Nebraska resident and a parent I am appalled! I heard only a very brief thing of this on the news this morning, but didn't realize it was that close to me. Unfortunately, we have much bigger, worse things in the news right now locally, so this isn't getting much notice. I'm going to check into who I need to write a letter to about this (as a voter here in Nebraska) and tell them I think his sentence is absurd!
 
That is one of the most ridiculous things I've heard. I've seen those catch a predator programs on dateline and there is one very short man in there, I wonder if that was him?

I've never heard of any judge not sending someone to prison because of their lack of height. In my opinion, she needs to have her head examined after she's removed from the bench. She told him to get rid of his porn, well sure he will, the judge told him so. :sad2:

Absolutely ridiculous!!! Makes me want to slap her right across the face! Well first I'd make her go out and get her own hickory switch then I'd wop her right across the face with it, possibly knocking some sense into her.
 
Everyone who enters a prison is in danger, why does he deserve an exception?

The OP was right, put him in jail, he'll see what it feels like to be physically at the mercy of much larger sexual predators.

Our prisons, the overwhelming majority of them, are simply hell holes.
I do believe everyone should be protected from other more dangerous inmates. There is a difference between being punished & being in constant danger
Why should this guy be so deserving of being spared a gruesome existence, when others get thrown to the sharks?

That judge has oatmeal for brains!

so, according to this judge, if you are below a certain height (5'2"? 5'3"?) you cannot be a hunter of children? Tell that to the poor child who was hunted.
 
:furious: :furious: This just makes me FUMING mad! Just because someone is under a certain height he is "protected" from consequences the judge feels may happen to him in jail. WTH(excuse my abbreviation) but if they are soooo concerned about this happening to pedophiles why don't they provide a space in the jails just for them away from other prisoners? Personally, I feel they should be locked up in a cell with some 6'9" muscular, steroid using mate named "Bubba". Get the picture :thumbsup2 I'm sure there would be some kind of justice.

The judges rationalization doesn't hold water. There are people who enter the prison system all the time who have a disability. Some are in wheelchairs, some may be amputees. Some are even very old but they are all sentenced according to the guidelines set forth in state law. I guess there is not appellate course the prosecutors could take? I also agree with the comment already made about pediphiles being in danger. That danger already exists in prisons and I am sure that prison systems take precautions for those offenders.
 
Amazing, simply amazing! Perhaps our judicial system has outlived itself. Is it not child molestation if the 8-year old is too tall?

From what I've been reading, molesters of all types do not change amd most barely wait a week after getting out of jail before resuming their sick ways.

My ex-son-in-law was a corrections officer in a maximum security state prison and he told me the murderers and other violent criminals do not look favorably on child molesters and will make sure they get what's coming to them in the prison general population. I seem to recall him saying they do not interfere, at least not very quickly.

Too short? Bull! They all deserve anything and everything that happens to them! Perhaps street justice is the most effective way to deal with these animals.
