Got home to find water seeping through the walls in my walk in closet! Last time water was pouring from ceiling (for up to 5 days) and ruined many of my clothes. Just happened about a month ago and finally ready to file insurance claim for loss. Now it happens again! Fortunatley clothes seem okay. Big sombrero and 6 ft madonna Truth or Dare poster seem to be only casualties. So now they cut yet another hole in sealing and replaced pipes. Sprayed bleach on walls to get rid of big patch of mold growing. Blower needing to run 48 hours to dry carpet. Thank god I'm moving out of here in July, but enough is enough. Legal question - should I get a lawyer and sue apartment complex as this is now the 3rd time this has happened? Last time my dp was so mad at me for paying rent as he thought I should have been compensated for what happened. I didn't want the hassle, but I feel like a wimp for not standing up for myself. Any thoughts/suggestions? Suck it up as I'm moving in 3 months (and expect nice check from insurance company) or try to get some kind of compensation from complex (reduced rent for May?).:laundy:

I am usually a patient person, but this is too over the top...I would certainly expect some gesture from the owners of the apartment complex.

I don't know about the lawyer, are you prepared for all that hassel?

Since this is the third time, a written letter to the company asking for a specific compensation...ie reduced rent or what ever you feel fair...would be more low key but certainly due you.

You must be so ready to see the end of living there, and in that line could you leave early? Use this mess to break the lease, and have them let you?

Best wishes Kathleen

no, not really wanting to deal with the hassel. Moving into my dp townhouse in July. Tennent does not move until July which is why I'm stuck here for the moment.

I am surprised you insuramnce company didn't go after the apartment owner. You atre going to pay a deductible, neither you nor your insurance comapnt should be paying a cent. Maybe your insurance will go after them, but I would be sending a certified letter with pictures to the apartment management indicating they need to repair it and compesate you for your losses. With a date for them to respond. If you hear nothing back, contact you city, town, or state housing authority or health department. Think about this, water and drywall usually means black mold (mildew), which, if allowed to grow, can be toxic.
