Is this too low to pass ROFR?

Their number one factor IS to keep you guessing. If you can't pin down the number, you have exactly the situation this thread is referencing. And some of those will end up going retail instead which is ultimately the goal.

Well, their #1 goal is really to make as much money as possible off of you and others. By keeping you guessing, and by making resale a long and stressful process, they are helping themselves reach that goal.

Same thing, they do that by making retail sales. Related to ROFR it's keeping you guessing, making it confusing and causing stress. They use ROFR a number of ways to make retail sales but for those that actually are informed on resale, these are the ways they try to get some of those to buy retail.

Yep. This is exactly what they are hoping for:
There is really no striking the balance, IMHO. If you don't want to spend the time to play the resale game, might as well just cough up the cash and buy direct.

That, and by using ROFR, they keep the prices of DVC up and keep the system from falling apart due to a few desperate sellers. That is something I do appreciate.

Ideally they'd rather never buy under ROFR and just sell retail. That's where they make their most money. If they could legally block all resales AND keep the retail sales at the same level, that would be their preference. But that's not technically possible to the next best thing is the appearance one can resale but keeping the number of sales to a minimum. EVERY resale is a potential lost retail sale even for those that say they never would buy/have bought if resale wasn't an option.
