I'm so UPSET!!!! eBay issue... (vent)

DD was given my 1st generation Nano when DH bought me an iPod video. It died on her (it's been 6 years!) so she's been asking for a new one. The girl does great in school, plays hard on her soccer team, keeps her room clean, is respectful, I could go on and on, so I finally convinced DH to get her an itouch. Well, he didn't think he could spend $200 on one so I started looking on eBay. I bid on a few, but wouldn't go past $130 so I lost a few, but I finally won a bid for a brand-new, 3rd generation iTouch at $127 with $5 3-day shipping.

On 9/4, I paid through Paypal, and waited and waited and waited and waited. I sent a few messages to the seller asking when it would be shipped, but never received an answer. Finally, I sent a message saying that I was going to file a complaint through eBay. The seller sends me two messages, the first says that the item is no longer for sale, (duh, yeah, I bought it) and the second says that he never received payment. Really? Paypal says different. So I go to the eBay resolution center and they say I have to wait until the 17th to file a complaint!! Really? Why do I have to wait??? DD's bday is on the 28th so waiting until the 18th to complain doesn't give me much time.

Does anyone know a faster way for me to complain? What should I do?
 
There really is no faster way to complain. They have a date in place to ensure that there has been enough time for the USPS or whatever shipping method to deliver the item (even it was sent 3 day).

In the meatime you could always send proof to the seller that you have paid him and see what he says, otherwise you will have to wait until the 18th.

ETA: If you get your money back, I would also get a refurbished one through Apple, instead of usinf ebay. They have 2nd generation 8G for $150 with Free Shipping. It may be $20 more and the 2nd generation, but you get the Apple 1 year warranty and they do ship pretty fast.

What's pissing me off is that eBay doesn't give you the option of calling a customer service number!!! The guy is specifically telling me that he didn't ship it, but ebay only gives you certain options and then tells you that you have to wait!
 
cant you get the sellers phone number from ebay and try to call and talk to him,..Send him proof of payment. what about paypal..can you dispute through them?
 

You can also file a dispute with Paypal..they will put a 'hold' on that amount in the sellers account "IF" he/she has it available. If you paid by credit card, you are protected.

If you don't get resolution in the form of your money back, you can also file a claim with your credit card co. I hope you get this resolved in time for you to find another one for your daughters birthday!

Please, when this issue is resolved 1 way or the other, leave the appropriate feedback for the seller, to protect other buyers from falling into the same situation!
 
It's tough, but although you know the guy didn't ship the item and you paid, eBay has to, by their rules give him time to ship it. And, once you complained, they have to give the person so many days to prove he shipped it. The good part is, if he can't prove he shipped it, you will get your money back.

If you buy the refurbished one from Apple, you should have it pretty quick. We have bought a few things from them and am always surprised at how quickly it came.

Sorry you are having a bad experience. The good thing though, is that you as a buyer can leave him a negative. As a seller, if someone doesn't pay me, I can't.

Yup you get that right on the website. Just go to the store and then on the left hand side down towards the bottom there is the option to look at refurbs. In my experience Paypal is usually very fast with resolving issue. I have had 2-3 and they were resolved in 2-3 days. Just make sure you send them word for word what the seller told you.

Ebay doesn't have a customer service number, bc technically you aren't their customer, you are the sellers customer. With all the transactions that occur on Ebay it would be impossible for them to handle all questions, inquiries and disputes by phone.

That's not a bad idea. I might do that. It's just such a pain b/c she's sooooo good and I really wanted to do something awesome for her! I'm going to do the resolution through Paypal and hopefully I can get the money back in time to get the refurb from Apple for her bday.

This is the way to go if you don't get it resolved in time. I know its not as fun or exciting but I'm sure shes going to be excited either way about getting a new iPod
 
That stinks OP!! I will join in the chorus for the refurbs from Apple. I have bought 3 or 4 iPods and 2 iPod touches refurbed from them and have had no problems:thumbsup2
 
Aside from your understandable impatience (I would be!), I don't see the problem. Ebay will mediate, but they are asking you to wait THREE days to give the item time to arrive or the seller a chance to follow through and ship. Can't jump the gun. They have to be fair to all.

I would email the seller back with a copy of your paypal receipt. Out of curisoity...what kind of rating did the seller have?

:thumbsup2 I always use my credit card as the payment source through Paypal. They keep telling you that taking it from your bank account is just as good. NOT!!

I got beat on an e-bay item for about 100.00. I used my credit card through paypal. I filed the disputes and waited. After about 6 weeks, Paypal tells me that the seller withdrew as an e-bay seller and has no money in his Paypal account to reimburse me. Sorry. I then filed a dispute with my CC and it was taken care of within a few days.

Paypal then sends me an e-mail saying that their dispute center is the only way to solve disputes and if I use the credit card dispute again, I could be terminated with Paypal. Funny considering they couldn't do anything for me.

Do they look brand-new, no scratches, etc.? Did you ever need to use the warranty? How long did the battery last? My original Nano (which she has) lasted 5 years. It still works if it's left on the dock, but dies within 5 minutes if you take it off.

It was a new seller. I figured it was someone who received a free itouch for buying a Mac at the Apple store. Figures I'd get the a hole who doesn't want to follow up.

We bought my sons Nano as a refurb almost two years ago. It looked brand new. I think the official line is that the parts have been refurbished but the case (and box) are brand new--so then there would be no scratches at all. We have had no issues with it and the battery lasts well. I don't really know how long they normally last--he has never run it dry in one day and will charge it overnight if it is getting low.

I would definitely go the Apple refurb route, because I have just come across a wholesale website that sells products directly from China to people so they can sell them on ebay. You wouldn't believe the number of ipods, and they looks so real. At least with Apple you know you are getting a real one, even if its not there in time. If it doesn't I would also suggest getting a case for it and wrapping that up with the pic of the touch in it, then at least she'd have something :) Good luck, I hope you get your money back soon :goodvibes

ETA Apple offers free shipping but you may be able to upgrade to express for a price

Agreed. When my son tells me he wants to buy something on eBay I always ask one "how many sales and what's the feedback?"

Remember some of the number can be purchases and they cannot receive negative feedback as a buyer.

You will be reimbursed or receive your item. EBay totally protects their buyers (their sellers, not so much!) you'll just have to wait.

I totally agree with going with the Apple refurbs. I've brought about 7 ipods in the past few years from them and all were great. :thumbsup2 The inventory changes frequently so keep checking back.
 
7:48 has come and gone and DD is officially 11, without a new iPod. We told her about her present, but to date, I am still waiting on a resolution with Paypal.

They escalated the resolution on the 19th and gave the seller until the 29th to answer. I have not heard anything yet which I think means he hasn't responded.

Has the seller not responded to the claim for anyone that filed a complaint? I'm wondering what the process will be next.

Hopefully, we get the $$ back soon so we can buy her her birthday present.

On a good note, I received her ELA scores today and she scored perfectly on her Language Arts test. Having the iTouch would've been such a great present today so this situation really sucks.
