So. This summer has had its highs and its lows (really low ones). One of the lows was a car crash that happened a month ago. A friend of mine died in it and another was sent to the hospital in critical condition (he’s still there). Both of them were intoxicated. The driver, however, was not. He was 100% sober according to the breathalyzer. He was also 21 and driving without a license.

Here’s what ticks me off: he’s not being charged with ANYTHING as a result. No negligent homicide, no assault (on the kid in the hospital), not even a fine for driving without a license.

I’m livid about this. And the other two weren’t even really close friends of mine. I knew Dan pretty well because I knew his brother, but Suda was more of a “say hi in the halls because we ride the same bus” kind of friend. But to not charge the driver with ANYTHING? That’s ticks me off royally.

I just needed to get this out there.

I'm so sorry about that! I know how it feels because not too long ago one of my friends died in a motorcycle accident.
That is really dumb that they wouldn't charge him with anything. I agree with you on that.
 
:hug: I totally understand where you're coming from. While I don't the whole entire story, from your point of view, I'd say the driver should be fined.

but maybe they are letting him off for driving without a license because he was sober, and i'm sure he's completely traumatized by the whole situation.
was the accident his fault? if it was, he should certainly be fined for something, but if the accident wasn't his fault, I can see why he might not be charged or fined.

According to the local paper's statement from the police it was his fault. He was doing 60 in a 30 on a residential street, lost control for no reason (at least that the cops can find) and struck a tree. The boy who died was ejected through the windshield because he wasn't wearing a seatbelt and Dan was wearing one, but they don't think it was functioning properly (they said in the paper that it looked like the locking mechanism that buckles it in malfunctioned and the belt came loose).

I just...I feel like something should have been done. Since he was sober and there isn't any cause they can find.

and to answer Shelby's question, he had one at one point according to a friend of mine who knows him, but lost it for reckless driving/repeated DUIs. That's why I don't get why they're not charging him. He's got a history of bad driving.

I guess it's all building up, too. This is actually the third crash this summer where somebody I've been friends with has died. My friend Stephen died in a head-on motorcycle/truck collision in May and then my friend Nick was in a solo crash two weeks ago when he feel asleep at the wheel. This summer just hasn't been good to me. My mom was diagnosed with bladder cancer (treated and removed. the doc thinks they got it all, but they have to wait and see for sure) on top of all of this, too.

Ok, knowing the whole story, he should definitely be fined or charged with something. That's reckless/careless driving. I got slapped with a "careless driving" ticket for rear ending someone accidently at a yield sign (I thought they were going, I look behind me for a second to make sure the street is still clear, didn't see them stop for no reason because the street was clear, and hit them). If this guy doesn't get anything, that's really upsetting.
 
Was there a relashinship with the people in the car? And Im so sorry to here that!:hug::hug:
 
patti i think you should call the da over this case. i'd be really really interested to know exactly why its okay to drive with a suspended license and kill and injure someone.

A few members of his family are already filing an appeal to the decision to not press charges. I was talking with his sister the other day and she said they just couldn't believe it. The boy who was driving was a family friend, but they still want justice for what happened since it proved more than ever that he's a menace on the road. Dan's family is thinking of suing to cover medical expenses, since he'll need quite a bit of intensive care.
