There are several things here that "leap" out at me..

Fist of all - if he were "mentally ********" - to the point of not knowing the difference between right and wrong - how did he make it as far as the 9th grade?

Secondly, how can a "mentally ********" person be classified as such without the proper testing?

Thirdly, I have known and worked with mentally ******** people in the past and unless they have the mental capabilities of a 4 yr. old, they ALL know that MURDERING someone is WRONG..

Last but not least, if he was "mentally incompetent" at the time of this murder, did it ever occur to anyone that it may have been the result of his drug use? Being a drug addict does NOT excuse anyone from being held responsible for their actions at the time of the offense - anymore than being an alcoholic excuses the drunk driver who murders someone while driving under the influence..

This is RIDICLOUS - and I feel SOOOO bad that your family has to deal with this dragging on and on..

And situations like this cause people to have no faith in the criminal justice system as it show little concerns for the victims of crimes but bends over backwards to give EVERY criminal the benefit of the doubt to excuse their actions.

Hound, I am sorry you and your family are having to relive this tragedy again and again. I cannot begin to imagine the pain this has caused for you and your family. I agree with Jeff -- one day this killer will meet justice, either in this life or in the next one. Please accept my sympathy for the grief you and your family have carried for so long.
