Hypothetical Question....

Definitely sounds like a scam - you're company most likely won't be held laible for this "accident". My family had a "trip and fall" accident at a store about a yeay ago - my 4 year old son tripped on a ruffled up mat in the entryway of a store and fell forward - hitting his head on a metal pole there in the entryway - gashed his head open and got 8 stitches in his forehead. The store was not legally liable for the accident because our law states that to be liable the store would have had to have know about the hazard and consciously chosen not to correct it. The store did pay for our son's medical bills but we did not request it, their insurance contacted us the next day.

Many people assume that if you fall on someone else's property they are automatically liable for your medical bills/pain and suffering, and that is not the case. Here anyway, they are only responsible if they knew of a hazard on their property and chose not to correct it. This particular customer chose to put her leg up on the counter and put herself in a position where she could easily fall. She'll probably try to scam the insurance carrier and negotiate a settlement directly with them - no decent lawyer would take her "case" or take this to court.

What happened to taking responsibility for one's own actions? People need to get a grip and stop being so sue-happy. If you want/need money that badly, get your butt to McDonalds and fill out an application.

Just don't let this person serve the coffee. She'd sue after burning herself (after being warned about how hot it is)! :rotfl:
 

I agree that the woman "should" be held responsible for her own actions and that it's probably a scam.

Here's what I think will actually happen: She'll file a lawsuit, the company will pay her medical bills and offer her a small settlement which her attorney will advise her to accept. It will cost the company less money to settle than it would to litigate to trial and the biggest mistake the cashier made was attempting to remove the tag for the woman once her foot hit the counter. She'll probably come away with this with a few thousand dollars. Disgusting isn't it? :rolleyes:

Can't fix stupid but you can litigate the heck out of it and 9 times out of 10, in our legal system, stupid gets paid.
