How long can a seller hold your funds?

pixiedust: Welcome Home! pixiedust:

We had a longer wait until closing on our recent resale contract. But most of the time was because of ROFR waiting (29 days). Waiting is so hard to do!

Oh no, now I've got that old rock 'n roll song in my head, dum, ditty, dum, dum, dum ..... is hard to do :rolleyes1

Congrats! I was following this b/c I'm on the hunt for same contract (100 VWL). Very glad to hear it worked out for you! Hopefully my experience will be better (first try at resale).

Also glad to here you got your VWL points! I love that resort, just stayed there a few weeks ago… :thumbsup2 Did you happen to hear what caused their delays? As others already suggested, a divorce on their side definitely crossed my mind as a possible cause.

Congratulations and WELCOME HOME!

And thanks for letting us know how it worked out. :)

Hi, Thanks everyone. It is GREAT to BE HOME!!! I am so thrilled to own at VWL. I love this resort - and it is my grand-daughter's favorite. I never did hear what the delay was other than there were 3 owners and they decided to get together at one place to sign and get signatures witnessed. Then they had not signed all of them and had to do it over again... But all is well that ends well. Now I am just waiting for my points to be up!!!

Is the seller overseas? I attempted to buy a resale with the seller based in the UK, and he was taking a long time to return the final paperwork. I spoke with the rep from the title company and was told it is much harder to find a notary in Europe and they also charged something like $ 300 to notarize documents. I finally asked TTS to cancel the contract. I found another resale within a few days and made sure the seller was in the US. We closed about 3-1/2 weeks later.

This sounds like a poor excuse from someone, I live in the UK and once needed to find a notary. It took a quick 1 minute search on the internet to find a list of them here. The nearest one that was available had their office 15 minutes drive away from my home and I dont live in a large city. Sure they are not on every street corner but they do exist and you should be able to see one within a day or two at most.

It's been 3 weeks since the total funds and final paperwork has been received, but one of the sellers is ill, and as of last Monday (the 9th), her paperwork hadn't been received. I've e-mailed Jaki to find out if it's been received by now, but haven't heard back. We are concerned because the person is ill, in the hospital and I've asked Jaki to keep us appraised of the situation. We began this process on September 16th.

PS. Redbudlover, I'm glad your resale experience turned out positively! I hope ours does too, and soon.

Gosh, Bobbi, that is too bad about one of the sellers. It makes it hard to decide what to do. Good luck! I hope it closes soon!

You are not kidding when you say it makes it hard to decide what to do. Jaki told me to be patient. I think we have been. If there is a 30 day deadline, I'm inclined to back out, today is day 21, so there's still more than a week. I read my papers and if that's in there, I don't see it. What is bothering me the most is that last night, Jaki wrote me an e-mail saying she would find something out this afternoon, but I haven't heard from her yet.

Jaki did get back later last night and the paperwork is in!:goodvibes

Got an e-mail today and the contract has closed...so we're down to the last waiting period, to see the points in the account!

Congratulations, Bobbi, you're almost over the 1000 point mark! BTW, it took us about 5 days (including the weekend) to get our resale points accredited to our account.

Thank you.

Yes, we will be at 1030 when these are credited. We are still heavily borrowed, and by the end of December when these points are used for reservations, we'll have no SSR points until the 2012 allotment! We enjoy our DVC trips, and we do feel it's been a great way to spend money for our and our family's benefit.
