A couple years ago, our dear friends went to WDW with us at OKW for the Millennium celebration. They liked it so much, they bought a 150 pt resale contract. The husband just passed away unexpectedly in October, and his widow now thinks she does not want to keep the DVC contract. She first wanted to "give" it to us, but DVC wont let her do that. Then we thought we would buy it from her, but we are worried they will buy it back instead. Any suggestions?

Okay - I think someone else is trying this - get listed as her associate member - you can then make reservations - but unless it is price high - DVC will buy it back.

Can you trade money for it - and then have it in her will that it goes to you? Of course that takes alot of trust on your part.

but otherwise I don't think you can. DVC has to change the name on its deeds - so I don't see any other ways around their buy-back.

of course there is the unlegal part - buy it from her at a high enough price that DVC won't buy it back - then after everything is settle - she can give you the money back - but I think that is not legal. Not sure!

That is what I was afraid of. She wants to sell it to us "cheap", and I told her I didn't think that was possible.

I am curious as to why DVC can't be gifted? We can leave it to someone in a will, but we can't gift it?

You could buy it with money on paper. Have her hold a motgage then forgive it. I don't see how that would be illegal. Of course, the forgiven mortgage would be taxable. This skirts the intent of ROFR but she she wants to give it to you anyway for some reason DVC isn't letting her do that....spruce
