Our contract was never sent to ROFR I just emailed to find out if it passed almost 26 days. Now everything is going to be sent over and have Disney expedited...Can we get out of the sale at this point since there was an error?

But if it's being expedited, aren't you back on track with no real delays at this point?
 
Do you know why the contract was not sent to ROFR? Did both parties return their signed documents and then the broker just 'forgot' to send it to ROFR? If so I'm curious as to which broker it was. Or did the sellers take extra time to return their paperwork? I wouldn't put too much faith in Disney 'expediting' ROFR, they didn't cause the delay and have their normal schedule which the broker can't cause to move faster. How long is the broker telling you ROFR will take @ this point?
 
Disney could care less about the delay and I doubt that they expedite anything unless they somehow get paid for doing so.

As far as backing out, what does your contract say?

Why would you want to get out of it now? Yea it sucks that you lost the 26 days, but finding a new contract now will take you even more time.
 
My last contract needed an addendum after 32 days in ROFR sitting on someone's desk. I was told that they would put a rush on it (but I didn't really believe them). It took 14 days from the point we signed the addendum, so really not too bad. I know it's a slightly different circumstance but all worked out well in the end. If you tried to get out of the contract, you would be starting from square one again anyway, so nothing to lose with letting them expedite this one at this point.

Whether you can get out depends on the benevolence of the seller/broker or the term of the contract as per closing date and any possible extensions. If it makes sense, I'd see it through.
